Immersion - the infamous patent holders for rumble technology - have been forced to pay Microsoft a one-off fee of around USD 20 million as a result of Sony implementing the technology in its DualShock 3 pad.

According to the legal wranglings, Microsoft tied up a deal when designing the 360 controller that included a clause for a USD 15 million payout from Immersion should Sony ever licence the technology for their own use.

they payed to immersion to not put the rumble technology in the playstation, these guys only know to use is unlimited money to destroy the game industry .Is because of this behaviour from microsoft that i try to avoid to buy their products

I sure hope that MS won't do to the gaming industry what they did for the computer industry.

Though this resurfaced now, its actually old. The fact that MS was suing Immersion is from last year, when DS3 was released.

There are plenty enough reasons to hate ANY company, but imo, MS is more deserving for their monopolic tendencies, specially in PCs world.

So? MS funded Immersion as an attack dog, and that's smart business. Serves Sony right for their arrogance - they should have settled.

Besides, do you really think "no one knows what a rootkit is, anyway" Sony really has clean hands? Everybody does this sort of thing.

Um... Are you serious? Nintendo is famous for such tactics as witholding the best cartridge technology for their systems so their games outshone 3rd party games on their system (IE - hurting the gaming industry), and using their dominant sales position to actually threaten retailers that if they didn't drop competitors' products, Nintendo would stop giving them stock to sell.

As for "No-one knows what a rootkit is anyways" Sony, this is the second generation in a row they've used propriety formats in order to make their games hard to port - because when they're on top, it means that the opposing underdog systems get crappy, lip-service ports - hurting gamers who don't buy Sony. Not to mention their DDE problems last gen which, unlike MS with RROD, they never re-imbursed anyone for fixing, their exploding batteries or...

Bottom line? You're most likely a blind fanboy, and not even that clever a one at that, seeing that you're getting on MS's case for making a perfectly legal contract and simply making sure it's enforced.

immersion did not have to sign the contract and i can't believe for a minute that sony and nintendo have not used the same tactics, it's called business and it's dog eat dog, survival of the fittest,always been that way, always will.

Is everyone on this forum completely business incompetent? Honest to god, rule number 1 in business is get ANY advantage you can over your competition. Sony was having a disagreement with Immersion, MS took advantage of it. If Sony had the same chance, they would do the same thing. And if they wouldn't, then they are just arrogant because it basically goes against every business instinct there is.

Sony had the HUGE advantage coming into this gen. Sorry but 120 million userbase >>>>> 20 million. Sony had a very mass market brand name. All they had to do was offer a system comparable to MS and they instantly would have won. So, MS is doing what any business not run by idiots would do.... they are taking every opportunity to reduce that market share advantage that Sony has.

MS isn't evil, they are just doing what they need to do to be successful.

Cow or not trying to block the use of mainstream technology is not something I appreciate as a consumer. And this gen I chose PS3 because it's a better machine, last gen I went Xbox for the same reason.

I'd use that money to recruit First-Party which Ms is seriously lacking. Now that 3rd party developers are thinking multiplats, Wii and PS3 has their own solid First-parties.

I guess it's a way of holding the industry back a little, but really we've seen much worse than that.
What to think of Anascape, Hillcrest, Interlink, Lonestar inventions, Copper innovations group, and all the other patent trolls (which just so happen to be all based in USA/Canada)?
They're much worse if You ask me.

They didnt try to block Sony at all. MS just invested cash with expectation that they would share in profits. It was a genius move actually.

MS expected them to get it, and pay for it dearly. That is why they requested the deal. Now with the deal MS got the technology for next to nothing, while sony paid almost 150mil total. Who failed?

Especially when Microsoft didn't invent it in the first place.

Honestly, the patent system is bs. How is it "good business" to take something that had already been invented, patent as your own (because it wasn't before), and then try to prevent your competetors from doing the same thing?

The system is just asking for the monopolization of technology products.

Sony and nintendo may have pulled **** back in the day, but Microsofts habit of throwing money around this generation doesn't earn my respect at all.

Note: Microsoft did try to prevent sony from using the rumble feature, and there were rumors that there would never be a dualshock ever again because of it. Obviously, Sony came back with the dualshock anyways.

Business allowed a company called Monsanto that specializes in pesticides and seeds immune to their pesticides to sue farmers for having plants on their land that stemmed from monsanto trucks accidentally spilling the seeds out of their trucks. Monsanto was challenged in the (canadian) legal system and won.

But I guess because its all legal business, its okay?

Just because its business and it works in the legal system doesn't mean its complete BS.

never said it wasnt, Im siding on the fact that its BS but because they didnt do anything illegal the system cant attack MS for abiding by a contract. Sadly nothing can be done and thats life and lifes a b**ch :(

MS did nothing wrong here and Immersion would have persued its litigation with Sony with or without its settlement with MS. MS new they and Sony were going to lose so they worked out a settlement which minimized any dammage to them. Sony would have payed out the 120 million regardless.

Have you ever heard of business? That's what that was.

Immersion agreed to the contract that MS laid out for them when they settled out of court, they didn't have to agree to those terms and Microsoft isn't the bad guy for making them hold up to their end of the bargain.

And hell, this could be a positive. 20 million dollars is more than enough to finance a new IP or two in one of their development houses or it can be used to boost the production values of a game currently in development. If so, this is a win-win for both Microsoft and 360 owners.

Um, way to outright lie?

"The Supreme Court issued their decision in May 2004 and one can view the decision as a draw. The Court determined that Monsanto's patent is valid, but Schmeiser is not forced to pay Monsanto anything as he did not profit from the presence of Roundup Ready canola in his fields. This issue started with Monsanto demanding Schmeiser pay the $15/acre technology fee and in the end, Schmeiser did not have to pay."

Do you post garbage like that in the hopes that no-one will bother to call you on your BS, or do you just have no idea what you're talkinga bout? Essentially, what the farmer (Schmeiser) wanted was the right to sell that GM product which accidentally ended up on his land as if it were his own, owing nothing to the people who had dumped millions of dollars and years of research into developing it. He lost that right, and Monsanto kept the patent for it, but didn't have to pay the regular fee for having the canola on his land. As in, he ended up spending nothing, and didn't get to rip the company off for something he didn't do squat to procure.

people hes right MS made a deviant move by trying to pull this on sony...but you forget Immersion signed the contract. Immersion could have rejected the deal but they didnt and now this is the result. You cant call MS evil for abiding by the contract...thats not to say however that they are right in doing this. I hate MS' practices they are currput and dirty but completly legal so for now, theres nothing anyone can do but move on
