I was doing a little research and I found out that Sucker Pawnch is an independent studio, they work exclusively for sony since the Ps2 era because they wish so, if they wanted to make a 360 port (with additional content) and have Microsoft publish it (technically, not the same product and thus not violating Sony's rights to the original) there'd be no legal issues with it right?

Yes, Sucker Punch could go and make Xbox 360 games, however, SONY owns the IP for this game, meaning, that Sucker Punch couldn't take this game with them to go and work for M$.
Another example of a second party is Level 5, they can go and work with whoever they want (They do have a fued with M$ presently, due to TFLO), but SONY owns the IP's for Dark Cloud, Rogue Galaxy, and the upcoming White Knight Chronicles.
Heavenly Sword was made by an independent studio, but again, SONY owns Heavenly Sword, just not that studio. Same for Resistance, Ratchet, etc.
Does that make sense?
