As long as you aren't using assets or copying everything, they can't sue them. Just like with All Stars, you can't sue someone for taking your game concept, a game concept doesn't belong to anyone.

They can. The entire level layout down to the coins and the clouds has been copied off.

All Stars was totally different, it was the same concept but different execution, this is pretty much the same game but without Mario in the lead.

I'm not a lawyer, but those screenshots look very similar. I'm not sure the company could defend against a lawsuit.

wah all stars execution was totally different? all stars is an almost whole sale rip off the few differences between it and smash brothers dont change that.

More likely the Apple Store will remove the game. I really cannot believe that iOS does allow the lack of originality of games and it gives me a somewhat negative attitude towards it.
