A 2nd party is pretty much a 3rd party obligated to work with a 1st party.

take insomniac games as an example. they only develop for sony platforms but they aren't owned by Sony. so they aren't 1st party, and they aren't 3rd party because they don't make games for other systems. so they are 2nd party.

Generally it's when an outside developer makes an exclusive game that gets published by the console maker... for example, SquareSoft was in an exclusive contract where Sony would publish their games when Tobal No. 1, Final Fantasy VII, and Final Fantasy Tactics came out on PS1, so those can technically be viewed as 2nd party games. Likewise, Rareware was a Nintendo 2nd party from 1994-2002, as Nintendo held a near-majority share in the company and all of the games were on Nintendo systems. So in a nutshell it's where a 3rd party is exclusive to a company due to contract.

Halo is second party. Mainly because it was bought by microsoft, but microsoft isn't making the games.

no thats not right. microsoft owned a controlling interest in bungie making them 1st party

Actually it is owned by Bungie. Who knows, I may be mistaken. But I saw it in the Halo 3 title screen and on the website.

Or it could be a company that is under contract to make games for a certain 1st Party. 3rd Party working on a 1st Party Franchise. Company that is partially owned by a 1st Party Developer but still has some freedom they just can't make games on opposing consoles.

Actually it is owned by Bungie. Who knows, I may be mistaken. But I saw it in the Halo 3 title screen and on the website.

Bungie did own the Halo franchise but when Bungie wanted their Independence Microsoft let them go but Microsoft said that they had to give Microsoft the Halo franchise.

In some cases but Retro Studios and Rare is First Party they are owned in full if Half or Most of the company was owned by a 1st Party developer then they would be 2nd Party.

For example, Rare was a second party developer for Nintendo before they were purchased by Microsoft and now, Bungie is a second party developer for Microsoft.

So what are developers who are obligated to a first party due to an IP own by that first party but still makes games for rival companies of that first party? ie. Epic Games, bound to Microsoft with Gears of War but can still make games like Unreal Tournament for the ps3. Is Epic Games a 3rd or 2nd party dev?

Epic owns the Gears IP. they are 3rd party.

help me out, is the underlying tech the 360 platform? It's definately not the engine.
