These guys call themselves gamers and they aresuing microsoft just for not being able to get on xbox live? wtc. people like them are going to ruin the gameing industry. anyone else feeling thoughts of anger?

no. Microsoft provides a service and according to their reason for live's shotty service over the holidays was due to an increase in use, something they should have forseen and planned for. Paying $50 per year isn't a lot but when you end up not having the best service possible and the company breaks its contract with the subscribers than it deserves to be called to task for its neglect. They made money by not providing their service and won't be losing money by giving subsribers a yet unnamed xbla game.

No, why should I be? They are allowed to do that. They paid fora service that they are not reciving, if it was free that would be one thing, but it isn't. Why aren't you angry at microsoft? Do you like not getting what you pay for?

I think it retarted its just stupid people that are on thier period and have nothing better to do much bother people. seriously all you had to do was wait a few days and now its fine. Things happen folks, XBOX live was down for no more then 48 hours...this isnt the end of the world. I personally hope they get counter sued into oblivion.

It's slightly disturbing and irritating that some people can sue for anything these days. Just because they couldn't get on Live they sue, its pathetic. Yeah Microsoft provide a service but these guys are nothing but parasites looking to get rich.

These types of frivolous lawsuits are the reason why legitimate lawsuits never make it to court. A fifty dollar investment is not worth the 500 retainer fee for a lawyer and the headache of sitting in a court room listening to the drones battle your case out in court.

Im not mad at MS even though Live was buggy for awhile. I could still go on and play TF2 or Madden onl;ine with minor lag so it didn't really affect me. Sueing someone is like crying out that your a cry baby

yeah, but how is 5 million in damages worth that? i can understand being mad at microsoft. i was too, but 5 million b/c i cant sign on to xbox live? this is going to cause a chain reaction and everyone is going to sue them if they have a problem signing in. its going to kill the industry.

I don't necessarily agree with people suing MS, especially because MS will provide a free XBLA game, but still, people have every right to be upset. When you pay for something and your'e not receiving anything, there's cause to be upset. Some people here have said XBL was down for 2 days, which is completely incorrect. XBL has been having wide spread issues since Christmas, which was quite a while ago.

The only problem with MS giving a free XBLA game is that many people don't care about XBLA games. They paid their money to be able to play online, and that's what they want. MS should really just compensate people a month of XBL Gold, or at least offer one of the two: the game, or the month.

I pay a monthly fee for digital cable, telephone service, electricity, etc.

If I experience an outage, I feel I deserve a pro-rated credit on my next bill.

I don't feel I deserve $5,000,000.

that's actually what bothers me most in all this. "micro$oft giving away free game" is what i read everywhere.. they're not doing it for us, it's to make the general public think good of them because they don't know it's some cheap arcade game that most probably wont even like,. people who don't know think it's an actual $60 game.

if they really wanted to give us something, they'd give us points.. but they don't because the PR isn't as good as it is if you say you're giving everyone a free game.

I think they are stupid for trying to get SO much money for something that's not that big a deal but I do see their point. I just think it makes gamers look bad since people already think gaming is a waste of time and these guys are doing this because they couldn't play for a while. There was a funny article my buddy told me about where they said the reasons for the guys suing was because they actually had to socialize and go outside. It was pretty good.

48hrs...?? I was having trouble logging into live for 3 weeks. Halo 3 and COD 4 were having so many issues getting into matches and getting your friends to join. It was not just two days...more like 3 weeks. M$ should have known this was going to happen with all the sales of the 360 for the holidays.

They won't win the law suit. It will most likely be droped. If they were able to login successfully once in a course of a month then they were still using the service. The user contract protects microsoft from legal action as a result of service outages. If these guys had read it when they signed up for the service they could have saved themselves some time.

I have no love for microsoft, but it's kind of depressing to see that we have reached a point where not only are there people greedy and selfish enough to go through with such a lawsuit,but that there are so many people (on this forum) that agree with it.

The service is only $5 a month....how did they come to the conclusion that they deserve $5,000,000 for this situation....sure a month or some microsoft points would be great....but it's $5

which just goes to show how much of a corrupt POS microsoft is, "we make no guarantee that our service will actually work" well we make no guarantee that we wont sue.

i love the xbox 360, but hate microsoft (and sony, nintendo, and pretty much all money grubbing businesses, which is pretty much all businesses) and this fine print, **** the costumer mentality is why. every thing they've done to "please" the costumer is just to make sure they get as much money as they can, if they didnt cheap out when constructing the 360 the RroD wouldnt be a problem, and if they couldnt have been sued, they wouldnt have fixed it at all. its about the bottom line, not the costumer, and thats why i'll never be upset when any business gets sued, for whatever stupid reason. Be reasonable and realize that we were not denied service for very long at all and MS is refunding us the cost of one month with a free game. So I cannot see how you agree with this guy at all. Also, it's really not that serious. XBL was down, so what. Do. Something. Else. It won't kill them to go to the movies or just watch some TV. Shoot they have Live, which obviously means they have access to the internet, so why not surf the web?

In general frivolous lawsuits anger me, but I don't care one way or the other about this lawsuit in particular, mainly because the gamers are going to lose.

This reminds me of the judge who sued a laundromat for losing his pants and wanted millions of dollars for damages. I agree with the person who said frivilous lawsuits make them angry. All this does is tie upthe court system when there are more important issues.

for some reason I see this small band of upset gamers being the same kind of dudes who went out and bought numerous PS3's sold them for outrageous prices... gamer scum.

I'm not upset with them, its their nature to be lame. honestly, they marked themselves for public hate... their problem now, not mine :P

? If I'm paying for a service, I expect to receive it and Microsoft are right to offer a free game to cover the costs. While I don't agree with the individuals attempting to take it as far as the courts, I don't think that you realise the problems most people have with the downtime. It's not a case of "Oh, Live is down, now what will I do?".

My 360 blew up 5 dyas before christmas, my anguish and pain should be worth at least 10 mil lol

Even if they put that, it's not a valid clause because its abusive. In any case, they would put on everything and we would be screwed. If that would be the case, they would put this "Open this box and get the console out, the moment you plug it in, we are no longer responsible for the RROD."

The people that are telling people to quit whining are unaware that many others are still experiencing problems. And many have been for quite some time now. The persons that keep telling people to quit whining are usually little emo boys that are mad people aren't paying attention to them.
