i just picked up bioshock tonight and about ready to play it. my concern is that ive been hearing alot about the problems with the update over xbox live and wondering if i should just not update it due to the issues? thanks for any help

In my case, the update f up the game completely. The framerate was on the floor and everything else was pretty messed up, so I had to delete the update... and everything is fine again.
Just give it a try... if it runs smooth then keep it, if it doesn't, deleting the cache for a game is a pretty easy and short process.

You can clear your cache by pressing both shoulder BUTTONS (not the triggers) while the game is loading. (some say its best to press these buttons just after the 360 starts the game and just before you start to see the game).
If you play bioshock without the update, xbl will give you a message that tells you theres an update, however you yourself can choose wether or not to get it

yeah i already got the update and thats when it went wrong. If i delete the update, and try playing it again wont it just ask me to update again?
