that's ridiculus
1. this game has been out a long time so if they wanted to sue they could have done it like 2 years ago
2. cmon just because it is a zombie survival game type thing in a mall does not mean it is related!

The MKR Group, who holds the copyright to both the 1978 Dawn of the Dead film and its 2004 remake, sent letters on February 6, 2008 to Capcom, Microsoft, and Best Buy, claiming that Dead Rising infringes on the copyrights and trademarks of these films. In a complaint filed February 12, 2008 Capcom asserted that "humans battling zombies in a shopping mall" is a "wholly unprotectible idea" under today's copyright laws; Capcom further points to the warning "label" on the box cover as a preemptive measure to separate the game from the films.[29][30][31]

I had a bad feeling this would end up going through. Just hope it doesn't torpedo Dead Rising 2.
This Rubinstein fellow should look on the bright side. Romero himself hasn't made a decent movie in forever. Land of the Dead single-handedly ran the series into the ground, so it's actually all to the good if people mistakenly associate something as good as Dead Rising with Romero. But it's all about making a quick buck, isn't it?

This is about Romero's Dawn of the Dead, not the Zack Snyder remake. And as to whether this thing sinks or swims, I doubt "zombie speed" is going to be a big factor. ;)

actually the zombies in the original movie were slow and easy to kill there is even a few scenes where the people run through them and when the bikers break in they take the zombies down easily and even play with them.

Saw this on GameSpot earlier, already expressed my feelings in a comment about it, but figured I'd add a few more things:
A lot of people are angry that many are blaming Mr. Romero for the lawsuit, when in fact it was not him. I realize this, and what I meant by producer was Mr. Rubenstein. George A. Romero probably had nothing to do with this.
Secondly, I honestly think they aren't going to win this because there's no real proof. Sure the "zombies in a shopping mall" idea was copied, but not verbatim. There are changes left and right in Dead Rising versus Dawn of the Dead. So it's not like they copied the movie word for word, action for action.
I also mentioned in my comment about the movie Shaun of the Dead. I had people asking me about this movie after I posted the comment, and basically it's the same idea - a group of people holed up in a place of importance (If you could put it that way) while trying to survive during a zombie outbreak. Heck, the movie could be considered one big parody of Dawn of the Dead, if it weren't for the underlying romantic comedy.
Dead Rising is kind of the same way - campy, but with a few serious undertones. If anything, the people involved with the making of Dawn of the Dead should be extremely flattered, since all of it is skirting the bounds on parody.
How do I feel? I feel the whole thing is blown out of proportion. I'm usually not vocal about lawsuits but this one just crosses the line between valid and ridiculous.
Wow. That is ridiculous. Look at all the Zombie movies out there. They all are related to a previous one in one form or another. To say that Dawn of The Dead was the only movie that is similar to Dead Rising is ridiculous. The only similarity there is that he is in a mall.
