Those are new unopened copies. I'm sure the seller bought GH5 in hopes of getting Van Halen early and then selling it early to make some money. This has nothing to do with the quality of the game.
I understand I shouldn't Be sarcastic, I love Guitar Hero but it annoys me they Milk the franchise But It's good they Gave you Van Halen For free So don't let me irritate you guys that much
