I too have been trying to keep tabs on what free xbox live arcade game we are going to get (or choose from). I haven't found anything useful to answer your question, but it seems like the CES guy that did an interview with gamespot didn't know the specifics either. Here is the link to his interview:
I just hope that its made free permanently, instead of only for one or two days like texas hold 'em and carcassone were. With barely any advertising and only a very short amount of time for the promotion it wasn't really a very generous offer.

That is the point. They know they Or the company that made the game will technically lose money on this. So by making it limited time they can give it away for free, but then still make money off of it. Plus they can't really make a game not made by the free forever (unless they published) because the developer would go insane.
