I had bought a 360 awhile back and had a user name... then i finally bought the Gold membership and made a new name, so I had to play all my games all over again to get my points again...

My cousin is going to get a Gold account... is there a way for him to use the name he has right now as his XBL account? so that his points transfer over???

You should just be able to connect your original account to Xbox Live rather than setting up a completely new account. You may have to change your tag, but it should keep the points.

So, TC, you had silver? Or did you have a completely offline account? Your cousin can keep the name, he just has to go to the XBL blade on dashboard and select Join Xbox Live. So yeah, he can keep the same account.
