I was able to make a newpassword on xbox.com, so i'm still able to get into xbox.com. Now the a55hole still has my profile, and gets on every once and a while, not to mention he already added 200$ worth of MS points. If I recover my gamertag in the morning, with the new password, will he still be able to use my gamertag? Since the password isnt the same

No he wont. He'll have to recover it and you need the password for that.

agreed, however I would call your credit card company about the $200 he charged as well as letting Microsoft know of the situation and hopefully they will refund your credit back.

I recovered my gamertag with a new password, and put one of those xbox live sign in passwords on. As for all the money he added, the credit card company has been contacted and there gonna help us out. Good thing is, I get a full year of xbox live for free, and tons of games he downloaded.
Track that son of a #&*$ down, file a police report. That will teach him a lesson. Actually, it probably won't. Most people that commit a crime never learn because they're too stupid.
Would you not be best to forget it and start again? I can totally understand if you wouldnt want to its the principle of the thing also with the charge thats lame as. I hope you can sort it all out and dont need to fork out the 200 and hopefully receive your tag back. But I wonder did he hack into it via xbox.com and then just change the 360 info around it? :|
