I bought a copy of Mafia 2 from Wal-Mart in the bargain bin(a bin where people can throw games aroud and cases get flattened) and when I opened it when I got home, the game was out of its holster and was flopping around getting horribly scratched. The Mafia 2 I got came on two discs so the main disc was this on this flimsy piece of plastic with the installation disc in the usual spot games are. Now it says here:

http://www.walmart.ca/canada-estore/catalog/helpcentercontainer.jsp?show=shippingandreturns

These items must be returned unopened: Prerecorded music, movies, software products, computer/ video games, ink cartridges and boxes of disposable contact lenses.

So I can't return a game I haven't even played or touched? I can't even play the game. My 360 can't even read it.

What do I do?

From working in retail, you can get away with murder with returns if you know what to say, and that it isn't some multi-hundred dollar return. Don't worry about the policies and just go in, explain what happened, and ask for an exchange/return.

Yupp. Just go and tell them what happened. They will definitely let you return it.

You walk in with your receipt. go custom services. don't bother talking to the complete min wage girl. ask for a manager. amazon is great place buy games. I had return few games. that have busted out of it's holder during shipping or something. AND never had issue with them. i wish they would open in store retailers and take out lame walmart.

that thing you referenced is only for returning games. you can exchange it for a copy of the same thing. just bring your receipt and tell them it was scratched when you opened it and it wouldn't work and i'm sure they'll let you get another one.

You cant get your money back since you already opened it, but you can get a new copy of the game. Just tell them that your system wont read the disc. Hell, Ive done it with several games I havent even bought from Wal-Mart. Ive bought several games from Pawn Shops and friends (Resident Evil 5, God of War, etc.) and they skipped a little in cutscenes or audio, so I just made sure Wal-Mart had it and I took it back and got a new copy, lol. I didnt need the receipt or anything.

Just exchange it for a new copy. They'll let you do that easily. Just a bit of advice that's helped me a few times. Whenever I buy a new game or blu-ray, I sit in my truck and I open it to make sure that it's not damaged or missing. I've bought a game where the disc was broken in half and it was much easier to just go back into the store from the parking lot than having to make the trip back. You never know if the right disc is in the case or if there is any disc at all in there.

You won't be able to get your money back, but you will be able to exchange the game for a new copy. (of the same game). I've had something similiar happen at Wal-Mart when I bought a CD. The CD was shrinkwrapped but when I opened up the CD case, there was no CD in there. I took it back to Wal-Mart, explained what happened and they gave me another CD.
