Well the reason BK is going to the XBLA is because Rare is M$'s plaything, and there is a new BK game coming out for the 360. Since Rare belongs to M$ now, dont be surprised to find Goldeneye in the marketplace after too long.EvilAshTwin
That wont happen, there was all kinds of drama about this last year when some photos were leaked and microsoft cut the project right as it finished (thanks to nintendo, fueling system wars like never before). We may see the old perfect dark and id like that but its just not the same...
The problem XBLA has is that unlike Nintendo and Sony, they can't just push a ROM out the door and call it a day, they have to rebuild it from the ground up. This is of course because Emulating an N64 on 360 would be illegal.
So theoretically, they could release any game that doesn't have a Nintendo name on it with no problem (barring other legal issues like obtaining 007 licence for Goldeneye or the WWE licence for No Mercy). What is a problem is seeing if the potential of the market is worth the cost risk.
With Banjo it's easy, big cult following plus potential new comers getting excited about the new release, it's making money and marketing at the same time.
SO! if there is ever another situation like this to come up, I bet Microsoft wouldn't hesitate in remaking an N64 game for Live Arcade (Killer Instinct?)
Except GoldenEye wont be on XBLA, because Nintendo doesn't want to share.
I'd cream if they released the original Conker. Then, they'd let the multiplayer go over LIVE.

Nintendo wouldn't have to. Microsoft owns Rare. Those are Microsoft's games now. They already made goldeneye with updates graphics but didn't release it.

The reason why they didnt release it was because of nintendo, thats why nintendo would need to allow microsoft to release goldeneye. The problem is ms doesnt want to share any of the profits and nintendo doesnt want to lose their golden boy of a shooter, so until each side can settle its squables, we will be without many great original titles...
They all need to have HD graphics. Or else I really dont enjoy them. I purchased streetfighter off XBLA and although I love the game, it looks like crap on my TV. I downloaded alien hominid and the color looks alot better. I cant play any game unless its HD my tv is too big for them to look good. So I dont care if ANY come to the XBLA.IIJuggaNottII

Any 3rd party, and or second party owned ip can be brought to live if those parties so desire. We have already seen this with games like castlevania symphony of the night, sonic, vigilante 8, and others. To clear up what confusion there seems to be about rare and the thinking that everything they made for the 64 has to be green lit by Nintendo:
IP's rare owns such as banjo and perfect dark now belong to ms. Things like donkey kong country, programed by rare using Nintendo ip will not be on live.
Goldeneye 64 is a unique situation because it is less straight forward when it comes to ips. As far as is understood, Nintendo would be involved in the ip path as they were the company to secure the bond license for the 64 game, and then commissioned rare to make the game. Not to mention the bond license with regard to games is now in the hands of activision I believe. There are conflicting stories as to how all the ips intertwine. The bottom line is, its not as straight forward as dealing with a wholly owned first or 3rd party ip.
I hope this helps clear some of the confusion up.

I see what you mean, that makes more sense for how some games will make it and some wont. I always assumed that nintendo had to be consulted for every game that rare puts on xbla, i thought maybe ms paid them enough to let this one get through but that makes better sense. Thanks for clearing things up, I should hae done my research before I stated anything, all I had were assumptions.

activision owns the rights to all future releases including goldeneye remakes,
mgm owns the license period , , and nintendo publish the game for n64, rare just developed it , but when they sold the rights to ea they sold the rights, then ea sold them to activision hince goldeneye rogue agent,
