They're banned from Live, that's all. When you own a console it's yours, but when you sign up for Live you agree to terms of service that include not modding your console. If you disagree with the TOS, you don't have to subscribe to Live. You can be disconnected for it and enjoy your modified personal property. I don't see what's so complicated about this.
It's not like your console is broken if they ban your account. Â
Videogame makers sell their consoles at a lose in hopes to make that up in software sales. If people are buying a console and not buying games, then MS just loses. Plus, all banned people are really losing is access to Xbox Live. They can still use their consoles to play games and such.Â
They did the same thing on the original Xbox. So, if you're shocked that your 360 got banned, you're just an idiot.
Oh yeah, I forgot about the cheaters. It is in their Xbox Live terms not to use a modded 360 to connect. If people have modded 360s, they can use it to cheat in online games like Halo 3. Nobody wants to play online games with cheaters. It just isn't fun. If Xbox Live is full of cheaters, people will migrate away from it in droves.
I had a modded original Xbox, but turned off the mod chip when I connected to Xbox Live.

We are not a Christian nation. We are a secular nation, who just happens to have a majority of its citizens as Christian. Perhaps the concept of seperation of church and state is over your head? Not all of us are Christian, or particularly like having Christianity thrust into our faces every time we turn around. And you think that justifies modding? Exactly the opposite my friend. When more and more people start the pirate lifestyle, games will only get more expensive as sales drop. Also, don't complain about 50 bucks a pop when many of us pay an excess of 80 bucks for our games. And you know what? We do it happily since we understand that pirating will only hurt us in the long run...Â

Actually, the whole disc scratching deal made me want to make back ups of my games. I still have three copies of Gears of War due to disc scratching and unsuccesful repairs. Which, I won't get refunded. So I was considering making back ups of my titles. And why shouldn't I be allowed to? In a hard sense of the word; I think if my own console tries to destroy my games, I at least should be allowed to make back ups of them.Â
The only thing anyone can do with a hacked firmware is play a copied game. THAT IS IT. There is no way to run unsigned code on the 360, what so ever. Backed-up games cannot ruin on-line play for anyone this time around. Since the 360 is almost impervious to any form of hacking.

So you think ti is right that some have to pay and others get everything free? It does not work like that. I am sure when you go to work you expect to get paid.
