So i read that some people get mistakenly banned for supposingly havin a modded xbox360, my question is this: let's say if i download banjo kazooie, and i become banned for saome reason, will i still have banjo kazooi on my xbox???

Okay, I'm going to assume, perhaps foolishly, that this is not a joke topic.

People who are whining about "downloading" games and being banned for modding aren't downloading them from XBL. They are downloading illegal pirated copies of the game, burning them to disc and then playing them on their Xbox. This is spectacularly retarded because MS has software that can automatically detect this over XBL while they are doing it. The result is the swift deployment of the banhammer, and the person pirating games doesn't get to play on XBL any more. Those of us who actually pay for our games then applaud quietly in the background.

If you are worried about downloading games from XBL itself (like XBLA games and Xbox Originals) and being banned, don't. That doesn't happen. You are downloading games form a legal source. MS wants you to do this. It is, after all, how they make their money. Note that Banjo isn't one such game, you will have to buy that on disc.

Now, if you are asking whether you can illegally download a pirated copy of Banjo, burn it to a disc, then play it on your Xbox knowing you will get banned, but continue to play it after your ban, then the answer is yes. The upside is that you will not have to pay for Banjo. The downside is that your Xbox will be banned from XBL forever and you will have to buy a whole new console next time you want to play online. Not really a good trade, is it?

wouldn't that mean piraters that didnt want/dont have XBL dont really get any negative effects from pirating? And what about achievment collectors, just pirate a ton of games and get achievments on your account, than recover the account on a new xbox?

I'm not a pirate or a modder or anything, but I think I see a flaw in this.  I think you can just disconnect your 360 from the internet when you play the pirated game, and simply hook it back up when you play an original. I know people who have done this, and their XBL accounts are perfectly fine.

Because a lot of people live on opposite sides of the U.S. as the distro plant, taking a week to get a game, then a week for you to return it, and another week to get a second game = bad :/

Couldn't they sue for copying the files?

Sure, but who's to say they know who is really playing their console? People can easily fill in fake information. And the cost of effectively tracking these people down would be unrealistic in comparison to the amount of money they lose. 

Also, if the person isn't connected to live, how would MS even know?

It is not that slow it is amazing. Plus it take 2 days for a game to arrive to me and I am 4 states away fro the shipping center.

its not that simple but i cant really go into detail because we aren't allowed to talk about that and im now a pirate either i just have knowledge on the subject.

MS track your ip address or they receive your key code. Remember no 2 xboxes have the same key code there for if your xbox comes up modded they will throw a red flag in your system.
