2nd Question: Yes

1st Question: Try going into voice settings and hitting voice through headet only. Other thatn that, I don't know what to tell you. Maybe get a new one. ??? Or try blowing into it (where you plug it in).

Be certain you're playing a game that has voice compatibility. The only sound that will ever come through that earpiece is the sound of other gamers talking into it. Make sure you're playing online in a game such as Halo 3, Team Fortress 2, or Call of Duty 4, or you're in a private voice chat.
