this is pretty common with electronic parts, i remember i sent out my graphics card multiple times because the ones they kept sending me were not even in working condition. what you have to do is just tell them how angry you are and say you will not recommend their product to anyone. that way they know you mean business.

I'm just writing to see if other people are having the same problems with xbox 360 warranty. First xbox broke and was having disc read errors. I returned it under warranty and when I got it back they gave me a older refurbished piece of junk that was now having problems different from my original problems. Now my xbox would crash and not work at all after it warmed up. After my second call for warranty work again they told me I would have to send it out again. This time I got an even older piece of junk returned to me. I'm p.o.'d because they didn't even attempt to fix my junk. instead they gave me someone elses junk. I wouldn't mind if they used refurbished parts to fix mine and if that was not possible at least give me a new machine. I just got my third xbox back today and now I'm really angry. They sent me one with manufacture date of 11-2005 and this piece of junk is so loud it sounds like a jet plane taking off. I also noticed when I picked it up that there is something obiously wrong and loose inside the console. I called 4myxbox again and they told me I would have to send it out for repairs again. Now I am not only out of the use of my xbox for several months but I also paid for two online gold memberships. They told me they would give me one month online service for free. How generous of them, they didn't give a crap how many gold memberships I have or how long I've been without xbox so they only could give me one membership for one month. They also told me that if I sent it out again that they could not guarantee that they wouldn't send me another used piece of junk. What kind of crap is this coming from one of the richest men in the world. I told them if they bought a new car and it broke down they would have to bring it in for service. How would they like it if the dealer returned an older piece of crap car to them with more problems than they originally had. I understand that things break on occasion but this is ridiculous and the service sucks worst than anything I've ever encountered in my whole life.
This kind of business practice is the kind that every dissatisfied consumer should get together and file a class action law suit.

They did the same thing with me. My refurbished one came to me and had this black sticky crap on top. It worked fine for about 6 months, but I knew it would break thanks to how it looked when I got it.
So I called and thought it would be replaced for free, since all consoles now get a 1 year warranty, and I was declined of that 1 year warranty because I requested to get the check for my first repair back. My first console was made in '05, thus this was ok. I don't understand why that matters since all consoles are supposed to get a 1 year warranty in the U.S. To make things worse, I haven't even gotten that check after making 3 calls already.
Instead the guy says he can take 25% off the fixing price, like he was doing me a favor. While that is better than paying $140, I am still under a damn warranty which is recognized because I requested back a check that I was supposed to get no matter what.
Great system, addictive, made like crap.
