Will i get away with it?

I recently bought a 360 (Last Friday) and got it last Monday. So i switched it on with much anticipation. I had it on its side and i had forza 2 in it. I tried to put the 360 on its side but when i did that it laser burnt the disk.

Anyway... Will i get away with sending it back saying when i got it out it was all scratched?

I doubt it but i wondered whether you would think i would get away with it. Incase you wanna know what shop i would be sending it back to then its amazon.co.uk

Are you asking that if you send it back will they give you a new one...

The Xbox you have is probably a returbned product, so you probably can get a new one if its scratched, or try phoning Microsoft an Bill Gates'll get you a new one...
