it said that it is going in north american retailers same with the hardened editon but on amozon.ca there is no hardened edition

So call your government, get a passport (because I think they are needed to cross the American/Canadian border now lol (because of all the Canadian terrorist of coarse :D))... drive to a bank across the border, exchange some Canadian money for some American money (I am pretty sure you can do that)... drive to a Gamesop and preorder/pay off the game then and there, drive back over when the game launches...

The Legendary edition for Halo 3 were in stores in Canada so I don't see why this wouldn't be.
