what you need to do is turn the headset on when the console is fully booted up not when it is on the opening sequence

I don't have the earpiece, but doesn't it have a little synchronization button on it to synch it up with your console?  Just press the sync button on the console and on the earpiece when you're logged in with your Gamertag.  Maybe I'm wrong, but that ought to work.

Turn on your 360 without having a controller on.  Then sync up your headset.  Then turn on your first player controller.  Should work.

That's how I did it.
