They would not get back to you unless you constantly pester them for an update on your situation. It took them 6 weeks to give mine back and that's only because I called them up sometimes twice a week.
It is highly likely it is gone, my friend had his account hacked and all Microsoft does is ban it most of the time, leaving you to create a new one, sometimes they do give it back, but if they do report any abnormalities in your gamerscore because I have heard of one case on this forum that someone was labeled a cheater because the hacker used it to gain gamerscore.
I dont want to start a whole new acciount because I had map packs on that account.

all I can say is pester them, sometimes they give it back, sometimes they don't, but it doesn't hurt to ask them concerning it, best case scenario they will give it back, worst case scenario they will just ban it, dunno what else to say there. I say in the meantime just create another account you get 1 month live free anyways, if they never give it back to you just use the new account, and just buy your map packs back later, nothing else I can really say other then that.

fail haha i have noticed through various threads that MS are fairly useless when it comes to recovering stolen/hacked accounts and most of the time you dont get it back
I'm guessing you did one of those "Get free microsoft points or 12 month free card here!" Thing right? Sorry to say but.... Hope you didn't have any credit card info on your profile =/
