Okay let's assume you have an original Xbox game. In this example, I'll use Dreamfall. Since this game is also on the marketplace, is it possible to download the game to your HDD with the disc in the drive without having to pay for it? I'd like to do this for faster loading and to avoid having to pop the disc in and out. I kind of doubt it's possible, but it's worth asking.Meleeboy
I don't think that the whole XBL (including marketplace) is that "sophisticated". The algorithm seems to be more like "Find -> Pay -> Download", no if/then.

No. That isn't possible. Microsoft has pretty strict copyright protection (DRM) for its marketplace downloads. The Fall update has a feature that lets you rip retail 360 games to your hard drive but the disc must be in the tray for the hard drive to load the game. Without the need for the retail disc you could just borrow games from your friends or rent them then copy them to the hard drive and BAM. Free game.
I don't know if this new feature will work with original xbox games. It's possible, but not very likely.
Well I was reading somewhere that with the new update they were gonna make it so you could "install" a 360 game onto your HDD so you could have faster load times and not worry about the noisy disc drive. Not if you're able to get it from the marketplace. Most people who buy those games don't have the originals.It's different, though. Xbox originals aren't free to download. You pay for them. That's why you don't need a retail disc to play it. Once this new update comes out its intended use is for you to copy retail games you own onto the hard drive. If you own the game having the disc in the drive as you play the game shouldn't be a problem. It isn't there so you can rent games, rip them and keep them forever without paying for them. I'm not saying you'd do that, but others would. I know I would. Microsoft aren't stupid. They aren't going to give us an update that makes it possible for us to break copyright laws.
On the flip side, if what you're asking was possible, you could borrow Dreamfall from a friend, put it in your 360 and download it for free then give the game back to your friend, then you've got the download forever. This is why the retail disc must be in the drive for the game to work from the hard drive. Only difference is it isn't getting on the hard drive through marketplace download. It's being ripped from the disc.

You make a good point there.
