No it's not since he has to delete them or he can never buy anymore on his own.

The common misconception is that Virtual Console games are tied to the console, that is false.
Virtual Console games are tied to the user, the stipulation is that you must own a Wii console to keep ownership. Once you give up Wii ownership your rights to the games expire.
When you sell or trade a Wii the games are tied to the previous user. Virtual Console games cannot be transferred to a new owner, they must be deleted.
Another fun fact is this. If you don't delete the games already downloaded and you buy more they don't go to your account they go to the old user's. Even more fun is if Nintendo ever needs to repair the console you lose not only the games you bought with the Wii but also every single game you purchased once it was in your possession.
I don't know why any seller thinks that it's adding to the value of the Wii to have Virtual Console games. All it's doing is showing that the seller isnt too bright.
That's only if you tie your My.Nintendo.com account to your Wii. And you can also "untie" your account as well.And even then, the account is tied to your Wii's serial number. Everything you download onto that particular Wii is still on that Wii. Nearly everything you said is false. Virtual Console games are tied to the Wii's serial number and that never changes. Get your facts straight.

Actually it does change. I sent my Wii to Nintendo for repairs and they changed the serial number (it doesn't match the one in the box anymore) and my Wii number. Get your facts straight it is illegal and HE HAS TO DELETE THE OLD VC GAMES.
