@pointingmonkey The problem with this is, according to intellectual property laws, you are indeed breaking a rule of fair use by creating a product out of an established IP (Angry Joe) and making a profit out of it (plagiarism). Meanwhile, Joe Vargas is working within the limits of fair use by presenting the product as is, acknowledging it is a property of its respective companies (ie. Nintendo, Naughty Dog, etc.). The product of his show being his actual written and oral critique, which falls under freedom of speech and general consumer rights.
Showing gameplay video and critiquing upon it should follow under fair use laws for media. Imagine if a movie producer tried to sue Siskel and Ebert for reviewing their movies. It's hysterical.
Nintendo is really overbearing about this issue, and it's really not helping their public relations image as well as their sales. And I say that as a lifelong Nintendo fan.

@joe_shickler Regardless of your reasons, you bought an overpriced machine with inferior service value from a company that spits in the face of gamers and is determined to milk them dry. We will continue to have fun at your expense.
