Australia bans Fallout 3

UPDATE: Upcoming Bethesda game refused classification Down Under by ratings body; OFLC report confirms banning is due to showing positive effects of in-game drug use.

Rumours were swirling late last week that Australia's strict games classification regime had struck its highest-profile victim for 2008, with Fallout 3 apparently being refused a rating. It seems the rumours were true, with confirmation coming tonight that Bethesda's upcoming postapocalyptic action RPG has indeed been banned for sale in Australia.

The most recent update for the Web site of Australia's Office of Film and Literature Classification (OFLC) shows that Fallout 3 has been refused classification. Unlike films or DVDs, the highest rating allowable for a game in Australia is MA 15+, which means any title that has content deemed unsuitable for a 15-year-old is illegal to sell or promote in this country.

While the OFLC website has no details on why Fallout 3 was banned, a user in GameSpot's PC forum last week suggested it could be due to the use of the drug morphine within the game. Australia's game classification rules state that titles that "depict, express or otherwise deal with matters of sex, drug misuse or addiction, crime, cruelty, violence or revolting or abhorrent phenomena in such a way that they offend against the standards of morality, decency and propriety generally accepted by reasonable adults" will be refused classification.

Fallout 3 is the third game in 2008 to be banned in Australia. Dark Sector was originally refused classification, although an edited version has recently been resubmitted and passed with an MA 15+ rating. Last week, Shellshock 2 was banned due to graphic violent content.

UPDATE: Australia's OFLC has provided GameSpot AU with a copy of its Board's ruling on Fallout 3, which states that the game was indeed refused classification because it contains "material promoting or encouraging proscribed drug use".

In its ruling, the OFLC states that "the game contains the option to take a variety of drugs known as chems using a device which is connected to the character's arm."

"These chems have postive and some negative effects (lowering of intelligence, or the character may become addicted to the chem). The positive effects include increase in strength, stamina, resistance to damage, agility, and hit points. Corresponding with the list of various chems are small visual representations of the drugs; these include syringes, tablets, pill bottles, a crack-type pipe, and blister packs. In the Board's view, these realistic visual representation of drugs and their delivery method bring the 'science-fiction' drugs in line with 'real-world' drugs.

"The player can also select and use Morphine (a proscribed drug) which has the positive effect of enabling the character to ignore limb pain when the character's extremities are targeted by the enemy." In Fallout 1 and 2, players could take a wide range of drugs both to boost health and character attributes. Both games were freely available for sale in Australia and were rated M.

And despite the violence in the game, the OFLC's ruling is solely concerned with drug use in Fallout 3. In the ruling, the OFLC states that "the violence throughout the game could be accommodated at an MA 15+ level of classification".

A Bethesda spokesperson declined to comment when contacted by GameSpot AU. Fallout 3's Australian distributors Red Ant also refused to comment. The company suffered a similar setback with another game it was distributing in Australia last year, when Blitz: The League was refused classification due to similar in-game drug issues. This is so upsetting. When will Australia get an 18+ rating for all us mature age gamers. I'm in my late 20's and have been looking forward to this game for years. Couple months from release and I find out I can't even buy it in Australia. Looks like I'll be importing the game now. Get your act together and get an 18+ rating in the games classifications already. I just don't believe mature age gamers should be punished because a select few parents can't take responsibility for their children, and simple minded people who believe only children play games. Rant over! Time to see where I can import this in from now! :)

WHAT THE **** Fallout 3 doesn't look anywhere near as bad as GTA IV. I mean you could hire hookers in it there was cocaine in it. You could run the streets killing tons of people.They gave GTA IV a 15M+ why not Fallout 3?

Well, now's probably the best time for Sony to promote the PS3 down under, 'cause I thought I heard you can pretty much order games from any region to play on any PS3, I can just see the ads now "Tired of old white angry men telling you how to live your life, well give them the one figure solute and buy a PS3, play what they won't let you and blah blah blah...". Come to think of it, games are about $20 USD cheaper in in the UK, about 50 GBP, while games cost about AU$120 (about $115 USD). So a 50 GBP game would cost about AUS$103 (so says Google). I don't have any idea how much taxes and shipping would be, but it could be comparably the same after all is said and done... or just do what I think I read what someone else said, and get it from New Zealand. Anyhow, you guys down under got bigger fish to fry. I hear the guy blocking the 18+ gaming classification is also trying to do a huge censorship of the internet to make sure kids can never ever ever under any circumstance view anything not suitable for all ages, and to guarantee that happens, that also means censoring adults content from adults. Better do something quick or you might have to go back to using your imagination to do that thing that gamespot won't let us mention directly.

I would imagine Bethesda would modify the game for an australian release, making chems look and sound less realistic. This kind of regionalisation has happened before. Remember Carmageddon in most parts of europe was released with radioactive zombies instead of pedestrians et al? Or even more recently Mahunt 2 in the UK? You might end up with giant day glo pills shaped like bananas (or something) but I doubt bethesda would consider overlooking such a lucrative market. Otherwise all they do is force Aussie gamers into buying import copies or downloading it illegallly, I have a vaguely different vie of this as I am a Pommy and will hapily be playing my copy of Fallout 3 (and then smokoing a big bowl of drugs I'm sure).

New Zealand has their own classification system, so many Aussie gamers import banned games from there. However, the NZ OFLC is quite similar to ours...just a warning, there.

This issue shows why an R18+ Classification is so desperately needed in this country. Australia is the only country in the developed world that doesn't have an R18+ classification for computer games. And no - I don't accept "but we don't need one" as an argument. Firstly, the average age of gamers in Australia is 28. This means the large proportion of gamers (ie. the people buying these games and helping generate revenu) are adults. So the whole "only children buy games, therefore we must protect them for their own good" argument doesn't fly with me. Having an R18+ classification will help responsible parents make better informed decisions about which games to buy for their kids. And countrary to what some people have claimed, having an R18+ classification isn't going to open the floodgates and lead to a torrent of "filthy" games getting into the country. As of 2006 only 2 games were refused classification by the OFLC. And Manhunt 2 was banned in New Zealand - which already has an R18+ Classification. So if a game is deemed to have offensive content, an R18+ won't stop the OFLC doing it s job and "protecting the welfare of helpless children everywhere".

The truly hillarious irony here is that Mad Max, the grand-daddy of all post-apocolyptic films and video games, WAS SET IN AUSTRALIA. That film was released almost 30 years ago, hahahaa. The Australian Film institute nominated Mad Max for both Best Director and Best Original Screenplay in 1979. So basically, a old sci-fi movie featuring roving bands of biker gangs and cop-killers gets nominated for best script, while a video game inspired by the same film in an almost identical setting is banned from the country. Makes sense :D

To all these highly intelligent people explaining that games should be rated the same/similar to movies. A game is an interactive experience, you make choices, perform actions, use items, etc. it's essentially you in the game. Movies are like a rollercoaster or fair ride it takes you for a ride, you don't make choices, nothing you think or do can affect the outcome. That is why games that feature similar adult themes as movies get rated higher because it becomes a choice, you choose to perform those actions. Hope that educates some people. In addition, the OFLC only classifies - and in the event it can't classify, it bans - it doesn't decide what makes a rating, it can't create ratings, it can't alter the classification of a rating, it just classifies. So to all those people ranting about the OFLC being dumb and stupid, they're just doing they're job.

By banning this game because of it's drug use says that you as a person and a citizen are incompetent. In defense of this statement, I give some examples: that you do not know the difference between reality and fiction, that you do not know the dangers of doing these drugs even though almost any student has been forced to go to a anti-drug program at some point in their lives, and finally (and most insulting) that you need to be protected from yourself, even though you might be a reasonable person, by someone you don't even know. What's next? Someone sitting in the passenger seat of your car, telling you how to drive your car after having 20 years experience? I can understand their concern but if they are so worry wart about it, make another category: MA 18+.

What's more likely is that the OFLC board members are so in the dark that they don't know what one actually looks like. Isn't that basically what morphine does? It doesn't say anything about an euphoric sensation, and therefore does not encourage misuse. EDIT: Also, why is it most people's first instinct to pirate the game instead of importing (which is STILL much less expensive than buying it locally in AU)? Don't punish Bethesda for the OFLC's blunders.

PS Pokemon also features cruelty to animals. And people Whoo-Hoo in Sims2. Oh yeah, and from what i gather about Spore there is an element of evolution ... but then ... there is the designer at the start ... so i guess that makes it ok for sale in all states of the US ...

pharcyde1521 - agreed, but i have suspicions that Burnout Paradise does away with a speed readout because it doesn't want to be seen as encouraging breaking the speed limit. Then again, speed is not what Burnout is about, its about causing crashes, and having a speed readout would raise questions over the game dynamics, like how can you catch up, no matter how far behind you are?

Here ya go OFLC.. Ban Pokemon, cos that depicts gambling to our kids.. Ban Burnout, cos that promotes crashing and driving cars at a ridiculous speed.. the poisonous mushroom from super mario doesn't give any benefits - it actually slows mario down (i think there are poisonous mushrooms on mario party games and a few sports games if i'm correct). the regular ones are just like champignons. the fact they are colorful is just an allegory and i believe they made it that way so it would look better as an in-game item. well, maybe we should stick with the idea they are poisonous and mario gets delusional after eating them and imagines he is a giant and nothing can harm him.. something like that... ya, now i wonder, why hasn't mario been banned as well??

I feel really sorry for the gamers in Australia. Here in the Phil, our government don't care about video games. They don't care even if there's sex scene, drugs, violence etc. on the game. Banning of games here is only a dream. Here, a 7 yr. old boy can buy anything on the shelves even if the game was rated M18+.
