Capcom Suing Ninja Gaiden Publisher for Patent Infringement

Dead Rising and Resident Evil publisher Capcom is suing Ninja Gaiden and Dynasty Warriors company Koei Tecmo for patent infringement, according to a report from Japanese publication Sankei translated by Siliconera.

The lawsuit charges Koei Tecmo with infringing on Capcom's 2002 patent for a system that lets players unlock content from an older game in a new title. The report also claims Koei Tecmo infringed on a Capcom patent that covers a feature that makes a controller vibrate when enemies are close.

Capcom says that Koei Tecmo's use of these patents "has greatly contributed to the sales" of its games.

In all, Capcom claims that 50 Koei Tecmo games infringe upon the publisher's patents. As a result, Capcom is suing for ¥980 million (about $9.43 million) in damages related to licensing fees, which covers about 10 percent of Koei Tecmo's total profits from the games. The publisher is also hoping to curb the sale of some Koei Tecmo titles, though these were not mentioned outright.

A Capcom representative said the company cannot comment on legal matters.

Capcom, you are so full of shit.


Ive been playing Tecmo games since Bomb Jack for the arcade back in the 80's and Ive not even notice this "enemy detection vibrate" function that apparently greatly contributed towards the sale of Tecmo games.


I used to like Capcom, they used to make some great games, now they seem to be a bunch of crying babies.

Crapcom strikes again. Looks like rereleasing Street Fighter with 2 extras doesn't sell that much, so this poor guys use some patents that should not even exist in the first place. Why do they only attack Koei Tecmo though? "unlock content from an older game in a new title" is part of pretty much every series right now, game series like Mass Effect put it on a whole new level

What's funny is the people saying these patents are ridiculous.


These are literally the same type of patents Apple has for their iSh1t and they somehow manage to win jabillions of dollars off of the most generic, unenforceable bullshit possible. Patents for products which in fact were filed long after the release of other products that did it first. Like their patent on the rounded edges design, or the GUI design, things that palmpilots and MS handhelds had years before iPod ever even was thought of.


Wonder why Capcom hasn't been banking off of them.

Okay Cappy we know you need money, but seriously, 9.4 mil, this is sad. Let it go. Or at least have the self-respect to ask for more money - you're going to waste 5 million of that 9.4 just on the court costs.

This should be a level in the next Phoenix Wright game. You can call in technical expert witnesses whether they are infringing or not from a technical point of view and gamers to talk about how these features make a difference in the game or not.

Ocarina Of Time on GC had something similar to where the controller would rumble when you were close to a secret, so should Nin sue Capcom?


....and unlocking content from an older game has been done before Capcom did it (original versions of games would fit here). Boy are they desperate as ever and obviously feeling threatened because they are becoming more and more irrelevant.

Oh, if this is the case, then SEGA would have to sue Nintendo for the analog controller(for the Saturn, the Nights controller), or maybe all of the companies developing VR glasses right now, because of SEGA VR project(1991).

Wait, so Capcom has a patent on all vibrating controller functionality? Jeeze, they must be loaded with every game developer/publisher on the planet paying them licensing fees. I don't think I've played a single game that didn't have that functionality in the last 5 years.

As for unlocking older content in a newer game, if the older content is your intellectual property you should be able to include it in your newer games. Patents created on simple concepts are just moronic. I think I'll go buy a patent on the concept of a video game character wearing sunglasses. I'm sure no one has bothered to do that yet, and I'm sure no one will bother to research whether or not that idea is patented, because it's such a ridiculous notion, so I'll get rich suing game developers.

Konami did the vibration thing years before 2002 back when metal gear solid on the playstation 1 came out so that patent is a complete load of bullshit.

That other patent unlock content from an older game in a new title is surely bull aswell.

Companies have been doing this stuff long before Capcom have claimed to have gotten their greedy hands on a patent for it.

I hope they lose.

Those patents are ridiculous. It's like if Nintendo were to patent controller vibration when an enemy hits you. They need to be thrown out and invalidated. This is Capcom trying to scrape together more money to save their sinking ship of a company. And it's sad.

Capcom may be able to let us unlock stuff on games, but when was the last time that was practiced? MVC2 on dreamcast? Since then you have to PAY to access what is already on the disc. I hope Capcom bottoms out. I understand business, but I have also been gaming before the initial crash of the industry, and I see the practices that companies like Capcom and EA inflict on the consumer to be the catalyst for the next video game industry crash.

Why... is this... a thing? So, Capcom is suing because of a feature offered in Tecmo Koei's games? This seems dumb. Down right dumb. Maybe I'm misunderstanding something, but it seems very whiny to me.


Granted, I want to kick someone in the balls for ruining Ninja Gaiden. That privilege probably belongs to Team Ninja or its new leader, but someone needs to get kicked. Also, it saddens me that Dynasty Warriors and Ninja Gaiden are being used in the same sentence now... smdh..................................................

I don't think this'll fly. A 2002 patent for a feature that I think most people would consider a basic function. Gears of War did this a long time ago.

Controllers have been rumbling since the '90's if I remember, so unless they copied that specific code, I don't think it'll fly (in which case, that'd be copyright, not patent).

Really Capcom? Really? Are you so GREEN with envy over how Koei/Tecmo is raking in MILLIONS in the DOA franchise through its numerous DLC? Square also implemented an unlockable content feature during the PSOne days. Iirc The Mana series + FFVIII had a similar feature. Granted not the same game but different titles activating freebie contents. Heck, Tecmo included a feature in DOAU where you can play Hitomi in Time Attack if you have a DOA3 save in your Xbox.

Then they should also sue EA for the Sims series. They have several expansion packs that add additional content to the base game.

Many gamers hate Capcom, there management of the Megaman series is awful and now this.

I honestly don't know whether there is an actual basis for Capcom to make such a move but if there is, they have the right to. Either that, or they are assholes. I admire Capcom and their games, and I admit that they have seriously went low in the recent years but I still hope.
