Capcom Suing Ninja Gaiden Publisher for Patent Infringement

Dead Rising and Resident Evil publisher Capcom is suing Ninja Gaiden and Dynasty Warriors company Koei Tecmo for patent infringement, according to a report from Japanese publication Sankei translated by Siliconera.

The lawsuit charges Koei Tecmo with infringing on Capcom's 2002 patent for a system that lets players unlock content from an older game in a new title. The report also claims Koei Tecmo infringed on a Capcom patent that covers a feature that makes a controller vibrate when enemies are close.

Capcom says that Koei Tecmo's use of these patents "has greatly contributed to the sales" of its games.

In all, Capcom claims that 50 Koei Tecmo games infringe upon the publisher's patents. As a result, Capcom is suing for ¥980 million (about $9.43 million) in damages related to licensing fees, which covers about 10 percent of Koei Tecmo's total profits from the games. The publisher is also hoping to curb the sale of some Koei Tecmo titles, though these were not mentioned outright.

A Capcom representative said the company cannot comment on legal matters.

I don't see why everyone is all upset and have to quote, "Oh they just want more money."


Let me ask you something. If you patented something long ago through the government, and someone uses it without your permission. Wouldn't you sue for damages as well? If not, than I guess you don't value your work.

Thats like Candy Crushes patent on the word Candy or the Edge Gameing company suing eveyr game company who uses ht eowrd edge ina game...it's ridiculous and in most cases was denyed.

Anybody know what's really going on here? Everybody violates everyone elses patents because it's impossible not to. So there must be a bigger reason that Capcom suddenly decided to sue. This is why companies need patents. Next, Koei Tecmo will pull a patent out of their bag and accuse Capcom of violating it, if they have one.

I'm never getting rid of that thing until it dies, but I love Ninja Gaiden and I want to play it with pretty graphics on my big TV on the couch. Not the old flats screen with dying pixels and horrible brightness, but its the only one with RGB cables anymore. :(

Best thing from Component video if you ask me when it come to standard content. I use the XRGB-3 to convert SCART to VGA the difference is... satisfying.


With that said I can't help but agree on some level HD remakes does make things oh how I love playing Metal Gear HD collection on my solid Plasma.

Capcom, its yourself to blame. You had tons of opportunity to make cash, but no, you cancel Megaman Legend 3, which A LOT of 3DS owners were really looking forward to and one of the main reasons on buying the handheld. Not only that, you blamed the fans for the cancellation saying that we were not giving enough support....really...You even ruined/killed off a lot of your major franchises also.

Al those robot Masters Powers not to mention his assist friends and MMXwith different armors. He should have been a shoe-in. Why the MM seres is Capcom's 3rd best selling series from DMC and Resident Evil. To think they tossed aside a good thing.


Many were looking forward to a MMX Collection on 360/PS3. People asked for a new MMX game, MMX in UMvC3, Megaman Legends 3, and folks was willing to support Megaman Universe. But Capcom just couldn't bring themselves to make the fans happy. Don't even get me started on how they let Darkstalkers die and the whole nickel and diming fiasco that's taken place with their fighting games. They're 2nd worse from ARSYSW when it comes to that. Which is nothing to brag about.

Capcom owns a patent on that? Seriously? In Ocarina of Time 64, when you get near a spot that has a hidden grotto, the controller rumbles.. could Nintendo have patented that, and locked Capcom out of another frivolous patent?

Setting aside for a moment the knee jerk "Capcom sucks and makes horrible games lately and that's why they're doing this" response.


If Capcom really did get a patent for a system that allows players to unlock content from an older title in a newer one, then chances are they have a decent legal case. Koei has basically been making the exact same game for about two decades now.

It isn't a matter of "if you can't beat them, sue them" since, frankly, neither company is exactly turning out paragons of innovation or masterpiece games over the last half decade or so...or longer. Patents exist specifically to incentivize innovation by giving a financial reward for doing so. If Capcom's patents have indeed been violated, then more power to them for trying to enforce them and get monetary reimbursement.

The patent system needs a major reformation, when you are able to patent the most miniscule and general things such as being able to use the line "with friends" in various media forms, there is a serious problem.

I've played all 4 of these games and I didn't really notice that any of them have these 2 features. So no, I really don't think those 2 features helped sell games at all, imo.
