Nintendo Sued Over Switch's Tablet/Removable Joy-Con Design

The creator of the Wikipad device is suing Nintendo.

Accessory maker Gamevice is suing Nintendo over its popular Switch console. As reported by Engadget, Gamevice claims the Switch uses the patents it owns without its permission.

"According to the suit, the Switch and its removable Joy-Con controllers are too close to Gamevice's vision of a combination of detachable game controller and a device with a 'flexible bridge section,'" Engadget reported. "Not surprisingly, the lawsuit calls for both damages and a ban on Switch sales."

The Wikipad (pictured above) features dual analog sticks, an analog D-pad, and four analog action buttons. A tablet/mobile device slides into the device to allow you to play mobile games with traditional console controls.

Gamevice said it has no comment on the case when approached by Engadget, and Nintendo has yet to chime on the matter. The lawsuit was filed on August 9, and you can read the full text of it here. We will report back with more details on this case as they're made available.

The Switch launched in March and has sold 4.7 million units by Nintendo's latest count.

The two items are entirely different in not just design, but the actual function. The Switch slides into the bridge and the joy cons are used separate of the bridge as controllers for play on TVs. The joycons attach to the tablet when removed from the bridge.

The wikipad is a tablet with a glorified controller dock. It is not a bridge of any kind that allows the tablet to be played on TVs. It is nothing more than a controller with speakers.

I don't even see how the two are similar. The switch has screen which has detachable controllers on each side, and the Wikipad is more like a big controller that has a section in the middle you can slide a tablet\screen into.

It's absurd for Gamevice to think they can monopolize the entire concept of a game device that has a tablet\screen and controllers that are separate from each other.

Even if a company has a patent, they can't enforce it if the concept and design is so intrinsically basic that it would prevent any variation of it and be an obstacle to future innovation by other companies. This lawsuit will likely be thrown out.

Gamevice must feel that they have a case, especially if they've patented something that they feel Nintendo has ripped off without checking. The world of patents and copyright infringement is a very complicated area, so I'm pretty sure they've done their homework here.

I wouldn't start loling at this just yet.

Gamevice is taking a huge risk. Attacking a huge loved company like Nintendo will make them lose a ton of business. I for one, refuse to buy Gamevice products now.

Yeah, that's not going to fly. The entire design is different. This cradles the tablet, while the Switch's joycons snap on to the sides.

Nintendo is already unaffected by a few simple reasons, the controllers themselves are seperate entities. The Joy-Cons are Bluetooth, HD Rumble, Motion controller, and amiibo support. All which the other company doesn't have. You can use the joy con with something else, as to the Wikipad thing is just that system itself. SEEMS LIKE SOMEONE TRYNA GET MONEY LOL. CLOSE , BUT NOT GOOD ENOUGH. Especially I doubt Nintendo would create something that would eventually be sued on. They have been around 100 years, experience.

I have never heard of them and I suppose Nintendo hasn't either. You can't copy what you don't know. Also the Nintendo Switch has 2 separate controllers instead of one controller with a "flexible bridge section". Their controller is an third party add on, but Nintendo's controllers are part of the Switch.

@naud: Nintendo knew, they have legal team dedicate to knowing. The legal rule is 35% of the tech can be the same, after that the patent applies. The issue isn't if Nintendo knew, it's if the tech is the same, which it's not.

Gamevice is using this as advertising, the laws need to change, so they can't just sue, lose and just pay costs, when its this obvious they should be made to pay damages for time wasted to the courts and Nintendo, hopefully this would reduce this kind of thing in the future .

If this was remotely legit they would be suing tons of companies, Logitech, Nvidia, Ipega and others, all who have released the same type of controller for android devices gamevice is selling.

Gamevice is going to lose this battle they have zero solid evidence to prove their claim the wikipad doesn't look anything like the switch or the joycon I have no clue what is gamevice going at with this lawsuit no one gave a shit about your wikipad even I tried the wikipad before and it sucks big dick the controller itself is too big and the analog sticks and the Buttons feel cheap sorry game vice but no one cares about you anymore we already have Razor Edge and ipega PG 9023 and they work flawlessly.

@rezerlius91: Even bad publicity is publicity. Nobody on this world even knew GameVice before they pulled this stunt. Now people know them. And they can always just draw the lawsuit back and call it a day, but now everyone knows them.

All just a marketing move. For instance, I had no idea what the hell Gamevice and Wikipad was until today. Neither did probably 90% in here, from the 90% in here, 10% will probably buy some shit of them now, and in a Japanese court of law, you get no huge sums anyway, maybe Nintendo pays them 800,000 usd or so for them to shut the hell up. All just marketing, relax guys.

I'm sorry but these guys can politely **** off? The Joycon design by Nintendo is ingenious and solves the problem of a feasible Controller for a tablet device. The design is perfect these jackholes are just mad they didn't think of it first. Personally I wouldn't mind seeing a more capable tablet like one of Razors gaming tablets with a Joycon like design I think that would be a beast of a handheld device while still being reasonably portable.

@JRD1912: That was Immersion v. Sony, actually. Immersion also went after Microsoft, but it was settled out of court. Nintendo was the only one who they did not seek litigation against.
