Nintendo Sued Over Switch's Tablet/Removable Joy-Con Design

The creator of the Wikipad device is suing Nintendo.

Accessory maker Gamevice is suing Nintendo over its popular Switch console. As reported by Engadget, Gamevice claims the Switch uses the patents it owns without its permission.

"According to the suit, the Switch and its removable Joy-Con controllers are too close to Gamevice's vision of a combination of detachable game controller and a device with a 'flexible bridge section,'" Engadget reported. "Not surprisingly, the lawsuit calls for both damages and a ban on Switch sales."

The Wikipad (pictured above) features dual analog sticks, an analog D-pad, and four analog action buttons. A tablet/mobile device slides into the device to allow you to play mobile games with traditional console controls.

Gamevice said it has no comment on the case when approached by Engadget, and Nintendo has yet to chime on the matter. The lawsuit was filed on August 9, and you can read the full text of it here. We will report back with more details on this case as they're made available.

The Switch launched in March and has sold 4.7 million units by Nintendo's latest count.

The hilarity, what part of this is infringing a patent exactly, the controllers, the housing, the mechanism, the tablet, the connections?

What an idiotic company all they've done is effectively bankrupted themselves with potential legal fees as this drags on and on with no payout at the end of it.

I bet there are hundreds of variations of tablet controller housing out there, I've definitely seen mobile phone ones.

The only way I could see Switch facing trouble is if they stole the locking mechanism of the joycons to the Switch.

Other than that the Switch is a tablet, the joycons are seperate blue tooth controllers, the dock is a usb-c to HDMI adapter.

@risingdawn: Nintendo filed their own patents for the Switch over a year ago and some two years ago. If there was any issue it should have come up then. Any lawsuit should have come up before now or at least news of one. Also ettgear makes a set of controllers for tablets and I couldn't find any connection between them and Gamevice and they still sell them. Guess Gamevice is upset over the Switches success.

@davillain-: Judges get paid either way...so what waste on taxes is this?? Either way, I'm sure this isn't going anywhere. How can you make exclusive something where design differs. But I'm no lawyer so I wouldn't know. All I know is, Nintendo seems to know how to walk away unscathed from many different situations.

@davillain-: it takes time to file. The Courts are backed up with lawsuits. Also they have a case they made similar things for Android and IOS as far back as 2012

Just looked up what this Wikipad is and it looks like they don't have a case. The Joycons and what the grip is for the Wikipad are completely different. The Wikipad is a grip for you to put around your tablet into and it has a controller, a mechanism on the back, and speakers on the bottom of the grip. The Joycons are just controllers you slide on and off the system and that's it. No enhanced sound, no mechanism on the back, and the Joycons are both their own object, not one big object you put on your tablet. Plus why don't they sue other companies that have been doing this before Nintendo. Is it because Nintendo's device is more successful then there's and everyone else's, so they think they can try and make some quick money off of Nintendo. Nintendo has more money and lawyers than they do. They will lose more money than gain. Also wouldn't they have done this closer to launch or closer to the reveal of the switch rather than 5-6 months after it was released.

Up to this point I have never heard of the Wikipad until now, and to be honest the whole plug a screen into a controller thing has been around for quite a while now. The Nvidia Shield for instance is one such device, and there have been all kinds of ones that connect to android devices in order to provide more of a console style controller experience with the screen able to be attached.

Just to challenge their idiocy with some lighthearted stupidity, Nintendo should now sue them for using standard unified D-pads and analog thumbsticks. Their implementation might be different, but on the surface they look so similar! Too close to someone's vision of something somewhen. Oh, the relentless horror of this realization! :'(
