Scarlett Johansson Sues Disney Over Black Widow Streaming Release, Disney Responds

Update: In response to the lawsuit, Disney has released a statement obtained by Variety. "There is no merit whatsoever to this filing," it reads. "The lawsuit is especially sad and distressing in its callous disregard for the horrific and prolonged global effects of the COVID-19 pandemic." Furthermore, the statement says the company has upheld its end of the contract, while noting the actress has already received $20 million for her role in the film, adding that "…the release of Black Widow on Disney+ with Premier Access has significantly enhanced her ability to earn additional compensation on top of the $20M she has received to date." Black Widow isn't done fighting yet. Scarlett Johansson, who reprised her role as Natasha Romanoff in the latest Marvel Cinematic Universe film, has filed a lawsuit against Disney, alleging that the company releasing the movie on the Disney+ streaming service at the same time it did so theatrically was a breach of her contract.

The news comes from The Wall Street Journal, which reports that Johansson's contract not only guaranteed an exclusive theatrical release for the film but that its performance on the big screen would ultimately determine the actress's salary. Of course, Black Widow was originally scheduled to hit theaters in 2020 but was ultimately delayed due to the COVID-19 pandemic.

When a new release date was set, it was announced that the film would hit theaters and Disney+ Premier Access on July 9. According to the suit, "Disney intentionally induced Marvel's breach of the agreement, without justification, in order to prevent Ms. Johansson from realizing the full benefit of her bargain with Marvel."

Per the suit, Johansson's team attempted to renegotiate her contract after the decision to debut the film on Disney+ was made, but Disney and Marvel were not responsive. However, in a copy of the lawsuit, obtained by Deadline, Marvel's chief counsel is quoted as previously saying, "We totally understand that Scarlett's willingness to do the film and her whole deal is based on the premise that the film would be widely theatrically released like our other pictures. We understand that should the plan change, we would need to discuss this with you and come to an understanding as the deal is based on a series of (very large) box office bonuses." According to WSJ, the decision to not renegotiate could end up costing the actress over $50 million.

Black Widow wasn't the only Disney film to get the Premier Access treatment, which allows audiences to watch the film at home for a limited time for a $30 fee. Before Black Widow, Mulan, Raya and the Last Dragon, and Cruella were all released with this model. Mulan was the lone film to initially only be released via Premier Access, as most theaters around the world were closed. Jungle Cruise--due on July 30--will hit theaters and Premier Access simultaneously and is currently the last announced Disney movie to be getting that treatment.

Likewise, Warner Bros. announced that its 2021 movie slate would debut on HBO Max and in theaters on the same day. When the move was announced at the end of 2020, some film creatives were not thrilled with the decision--namely Dune director Denis Villeneuve, who claimed he only learned his movie would be released on streaming through Warner Media's public announcement.

During its opening weekend, Black Widow earned $80 million at the domestic box office--along with an additional $60 million in Premier Access sales. The following week, though, theater revenue dropped 68% to just $26 million, a rather steep drop, especially for a Marvel Cinematic Universe film. Theater owners claimed this was due, in part, to people pirating the film following its digital release--a sentiment echoed in Johansson's lawsuit. "Millions of others who would have watched in the theatres will instead view the Picture on perfect digital pirated copies—-all made possible by Disney's decision to release the Picture 'day-and-date' on Disney+," the legal document reads. "Indeed, Black Widow was the No. 1 pirated title of the July 19 week, per the news site TorrentFreak."

Black Widow remains in theaters and on Disney+ Premier Access for those who have yet to see it. The next Marvel movie, Shang-Chi and the Legend of the Ten Rings, hits theaters on September 3. Beyond that, the Hawkeye series debuts on Disney+ on November 24.

$20 million for the movie and up to a possible $50 million altogether with bonuses? For what? 12 weeks of pretending? FOoHwtBS. I'm sure she has every legal right to do what she feels she needs to but, c'mon. When is enough, well, enough?

The part about streaming hurting the profits is certainly true. I dare to say that a big amount people has watched this movie for 'free' being it outside of Premier Access, 'community' screening (family, friends, neighbors, etc.), , shared accounts or in 'pirate form'.

A contract is a contract. If it's violated, she's correct to sue. The quality of the movie is irrelevant.

She needs to look at what she brought to the movie, how good her performance was and re-evaluate whether it’s worth more than 20 freakin million. Because I’m sure it wasn’t.

@bloodbornelore: Actually need to look at what the producers made because i guarantee you that any actor did more work then they did. Producers are like executives their only real job is to steal all the money from the people actually working for it. 20 million sounds like a lot but not if the producers made 200 million.

@gaeandilth: Good news, the producers didn't make 200 million. They also did far more work on the movie than Johansson. Movie stars don't come anywhere close to putting in the most work on a movie, yet they're usually the biggest expense.

There is a multitude of reasons why the movie didn't have a box office of a billion, and Johansson was still getting a cut of the Disney+ sales. The movie also did just as well as Fast 9 domestically, and Disney+ isn't available in Asia. She's just a scumbag.

@gaeandilth: You go do that then because Producers get paid a lot less than A-list actors, that’s for sure. Even Directors get lesser pay, despite having hired the actors themselves. It’s why Directors are lazy nowadays, Direct through a monitor and don’t respect their actors or the talent they could bring if they had some decent direction. It’s a mess. She still didn’t do more than $20 million though. That’s retirement money.

This is unusual. I think there's more to it than simply "Johansson is not satisfied". My bet is that Feige is behind this. He prospered under Iger, and he does not like how Chapek is cleaning house and swifts things around.

This is her agency fault that they dropped the ball.

Movie got delayed by a year due to COVID ( not production problems or her behavior) and her deal wasnt improved or had clauses. I recall jim carrey agent managed to get an injunction to block dumb n dumber unless he got paid accordingly due to ace ventura success, which resulted on him getting paid millions and jeff daniels barely hundreds.

Gonna have to bite the bullet because she already took the money.

@s1taz4a3l: The article or the previous one said her agent kept trying to re-negotiate with Disney since before the movie released, since they found out Disney was going to release on streaming, but Disney was non-responsive. So her agency did not drop the ball.

I was always impressed by the roles she played and her performance as an actress. But now she lost it. Well she already lost playing Black Widow. Why go there when you are such an established artist? Money. More money. And that brings us to.. she lost it.

Even as bad as [the] Fast & Furious might be, it’s not a childish take on Viking deities. Look at their version of Ragnarök. Are you denying that the humour and depiction of the Norse Armageddon wasn’t aimed at children? It’s basically Disney being all Hollywood again and desecrating the heritage of a multitude of European cultures. Instead of giving us a maniacal Kefka/Joker type of Loki… we get a watered down Tom Hiddleston version who isn’t even a good enough actor to be Doctor Who, let alone have any understanding for Loki’s vengeful desires and sorrowful love for his adopted family.

When it’s Luke Skywalker throwing his lightsaber away, you don’t desecrate the memory of that character just for laughs and giggles and not expect harsh criticism for it. I don’t expect you to understand these characters but the writers should have a pretty solid idea before they even put pen to paper.
