Multiplayer has become widely recognized within the game industry as a crucial component for keeping a game in gamers' consoles. In turn, a core aspect of an effective multiplayer mode is letting gamers communicate with one another through voice chat. However, the method by which EA, Sony, Ubisoft, and Disney have been allowing gamers to chat has purportedly been implemented without the consent of the company that owns the patented technology.

Last week, Plano, Texas-based Bareis Technologies filed a suit in the United States District Court for the Eastern District of Texas on grounds that the aforementioned gaming companies are in violation of one of its patents for optical disk-based voice recognition. The patent, which was awarded by the US Patent and Trademark Office in 1997, is described by Bareis as relating "to optical disks with speech recognition templates used to access information."

The suit specifically calls out a number of games from each of the companies as allegedly violating Bareis' patent. Ubisoft's Tom Clancy franchise is apparently a repeat offender, with games named including Rainbow Six: Lockdown, Rainbow Six 3, Rainbow Six Vegas, Ghost Recon 2, and EndWar, among others. The suit also named Sony's SOCOM franchise, EA's NASCAR series, and Disney Interactive Studios' Phonics Quest.

Bareis is seeking damages from all four companies in the form of royalties, negotiated at a reasonable rate, as well as interest on said royalties, attorney fees, and other relief as deemed by the court.

I think the Socom games have been out longer than this patent, Socom 1 had voice cammands back when it was released in 96 while the patent was rewarded in 97,

@agentzero23 = its messed up when patent litigation is used in this way by patent sharks to score some quick money, but ironically this really is the easiest way to sort out patents. the alternative is that the US patent office has to check any new patent against its entire archive of patents EVERY TIME a new patent is filed to make sure the idea has never been done before. patent litigation is an inefficient abused system that's unfortunately at the same time the most efficient way to to sort out all the patents that come from every wannabe great inventor out there. at least until someone can create some sort of computer AI that can sort through the various incredibly vague patents out there and do all the crosschecking.

Yeah, lets copyright methods of software development. That's a great idea. It's like drug companies suing each other because someone came up for the first headache medication....and someone came along and made a better medication for headaches. The same goes for operating systems, or any other product in the world. This lawsuit is going nowhere...my guess is that it gets thrown out.

Never knew there was seperate technology used to chat in multiplayer, I thought that was something the developers put in themselves. Learn something new everyday. On another note: It took Bareis THIS long to figure out companies were violating the patent? Or did they just purposely wait until a chock-full of games came out so they could get some money (most likely because with the recession they're in the red). THIS kind of stuff is what needs to be fixed in this country.

Funny how they start suing now..after the fact those games have been out for years. Simply Pathetic. I'd give a homeless person my dollar anyday..at least I can see they've lost everything.
