According to Eurogamer, Bethesda is taking Mojang to court. I'd really hoped they could sort it out or that Bethesda would be smart and just drop the case.

The Scrolls copyright dispute between Minecraft creator Markus "Notch" Persson and Skyrim publisher Bethesda is going to court.

"The Scrolls case is going to court! Weee! :D"Notch tweeted.

Notch had pledged to go the distance with Bethesda over the Elder Scrolls publisher's legal claim that Mojang's forthcoming Scrolls game infringes its copyright.

Last month Notch described Bethesda's claim as "bogus" and said "if we're going to court, I will fight this for as long as it takes".

He also noted that Bethesda itself has released several one-word-named games that share a noun with older titles, offering its new FPS Rage and cIassic Sega brawler Streets of Rage as examples.

Before the dispute appeared to take a turn for the serious, Notch offered to settle the dispute via a game of Quake 3 with Bethesda developers.

Scrolls is Notch and his studio Mojang's Minecraft follow up. The fantasy-based interactive collectible card game, which is without a release date, places an emphasis on strategy and tactics.

Bethesda has so far refused to comment on the situation.

I'm very ashamed of Bethesda. I can wait to buy Skyrim until it's cheap like Oblivion. They will get as little money as possible from me.

I lost faith in Bethesda when I learned they left PS3 gamers in the lurch on Oblivion. Their PS3 Oblivion GotY disc has a game-breaker bug that was never patched - contract vampirism, and it's pretty much game over, as you can't move around in daylight, and anyone good will either shun or outright attack your player. In addition, PC gamers had to rely upon modders to rectify some 10,000 glitches, which took three mods to fix. Again, consoles were left in the lurch because you can't mod the console versions. Load-Order for mods is so critical that you have to use 3rd-party utilities to ensure zero conflicts.

Shame on you Bethesda, shame on you for picking on the little guy.

Now if the game was called "Scrolls for the Elder" or something I could see Bethesda having a case, but as that isn't the case they don't have a leg to stand on.

This is unbelieveably counter-productive. Not only is there zero chance of anyone mistaking Scrolls for Skyrim (!), but it just serves as more exposure for Scrolls and bad publicity for Bethesda.

Yeah it's certainly a pretty lame move by Bethesda but I'm not going to not buy Skyrim or wait until it's cheaper so as to perhaps try to teach them a lesson. Hopefully this will get laughed out of court and everyone will just move right along.

The funny thing is that they (Bethesda) are tying themselves up in knots with this, and the ongoing situation about ownership of Fallout, just a shame they cant put all this time and effort into sorting out the bugs in their games, which are really good games despite the fact they are bugged to hell and back (thinking of FO:NV and Elder Scrolls GOTY when I say that).

I hope Bethesda and their $1000/hr lawyers get thrown out of court with great prejudice. The idea of copyrighting a widely used word is despicable.

Why should they? The game title isn't in any clear violation of anything. This is just Bethesda creating unnecessary drama for completely absurd reasons. Hardly something worth caving in on, I'd think.

I think you mean to say that the big apple i.e. New York City to sue apple computers for the use of the word apple.

I agree that this is just rediculus, a waste of everyones time. I just got started with oblivion with the intent to finish it this time. When I am finished I might pick up Skyrim.

Why didn't Mojang just change the name of his game and avoid all this? Oh and I guarantee all you so called Bethesda "haters" will buy Skyrim within the first week of release and love them again. So grow up.

If I understand you properly, what you're saying is the little guys should do what the big bad bullys tell them to do. Its good that Mojang are seeing this through as it will show that just because you're big and have lots of money you don't have the say on what others can or can't do.

Exactly. It's not like Bethesda has the word "scrolls" trademarked. That's like Square going after every company that has a game with the word "final" in the title. This is a crap move by Bethesda, and they will get a lot of(well deserved) backlash for it.

Why cant they spend this time on fixing bugs in their games?! Such as Fallout New Vegas, just the other day I walked through a rock and fell forever and my partners keep on getting stuck in the walls and ground.

If I'm not mistaken, Pete Hines (the PR guy) said in an interview that this was a legal issue, and the development team had nothing to do with it - hell, Todd Howard had a joint interview with Notch, and they seemed to get along pretty well, so I doubt the game is going to suffer from this.

I don't think it's the "cool thing to do" to "worship" Majang. I think (and I believe most other people on here do to) that it is the right thing to do in supporting Mojang in a case that is utterly ridiculous.

It's the princible of the matter that they don't change the name and see this through, and who's to say if Mojang did change the name, or lost this case so they have to, that other big delvelopers wont start picking on smaller delvelopers because the title of their game has a word that is in theres? If this happens Sega can sue any delveloper with a game with "Sonic", "Hedghog", "Streets", "Rage" and other words. EA could do it with words such as "Battle", "Field", "Dragon", "Age" and more. I think you get my point.

It maybe easyer to change the name but in the long run it would give the big guys more power in an industry that is practically run by them anyway.

And Notch should totally just respond with 'millions of Oblivion players haven't even heard of The Elder Scrolls series, and still refer to it as Oblivion 4'. Instant fatality. ...because, you know, that's how legal battles work, right?

His game is a card game called Scrolls. A fantasy card game in which the cards are probably printed on scrolls. What a silly lawsuit.

Although I'm supportive of him, I really don't agree with all this "don't buy Skyrim new" talk. Too many times people start getting up in arms over corperate descisions and they think that they can solve those problems by boycotting the developers that are making the games they enjoy. That's not really how that works. If you want games like that one to keep getting made, then support the developers, the legal crap will sort itself out.

So if a big company does something very obviously wrong, just because they are a big company, they little guy should capitulate to their demands, despite the little guy absolutely being 100% indisputably correct? Seriously, the comparison to the soon to be released Rage and Streets of Rage makes sense, if this case went against this guy, Sega could then sue the developers and publishers of rage into the ground based on precedent. Do we really need that kind of precedent set? Besides, we already have a precedent here, the guy that tried to copyright the word Edge was legally destroyed. Zenimax will likewise be laughed out of the courtroom. Can we have a discussion about this without insults as well? That would be nice.

Actually, his lawyers will likely just point out that millions of people loved Streets of Rage for years, and Bethesda Softworks and Id are obviously just trying to cash in on that. Seriously, that this company is suing someone for having a one word name game which just happens to be a word that is in the title of one of their series, while they do the exact same thing, just seems to me incredibly, insanely, laughably idiotic. It seems Zenimax/Bethesda's legal team is just a touch daft.

This is really stupid. They don't have the rights to every single word in their games! At least it wasn't Bethesda then that issued the lawsuit...it was like their parent company which is called Zeinmax I believe. :|

Why should Mojang change their name? When I say "Scroll" then I'm sure that most of people in gamespot don't ever think about Morrowind or Oblivon. So tell me why will it hurt Bethesda games if some company got a name "Scroll" on their game?

By suing Mojang will just help them get more attention to their game and make Bethesda look stupid.

Yes it is obviously wrong. Why do they care so much that another game shares a word with some of theirs? They most likely don't care about the name and they certainly don't need the money, they just want to flex their muscles and try pussing round the little guy.

You just don't get it, do you? It doesn't matter WHAT they want, the thing is, they want something that isn't theirs to begin with. It's the principle of the matter.

Definitely. It is frivolous and harmful. Minecraft is a big enough hit that Mojang can afford to fight this case, but they aren't going to come out unscathed even if they win. The time Notch spends in court and the money he spends on lawyers could be spent making Minecraft better and could be spent towards the completion of Scrolls.
