So just to confirm, if I no longer own my DSi I cannot get my DSiware on my 3DS?

I think that's a little ridiculous if true. I mean, I had a club nintendo account and all of my DSiware games that I bought should have been connected to my club nintendo account, just like my 3DS is connected to my club nintendo account.

Surely there is a way for Nintendo to let us transfer games that way.

That would have been a much better way to do it. But as it is, you have to download the transfer app on your DSi, and then have both the DSi and 3DS connected the internet to transfer. It will also not transfer saves over to the 3DS, and afterward its completely gone from the DSi. Club Nintendo certainly should have been used instead of this way. I traded my DSi in when I got the 3DS at launch, knowing I could loose my DSi downloads, but was still hopefull since they were all registered on Club Nintendo.

It's a great example of a poor online service from Nintendo. Your account should have registered licences, allowing you to re-download games you've purchased in the past, on other consoles
