Doesn't really matter though. Pretty much every Nintendo console gets breached yet it still does insanely well.
That's kind of fail. Sure, not too many people use piracy for the DS, but that doesn't mean some sales are not missed.

And just like with the Wii, I suspect there are going to be tons of people complaining about a "bricked" 3DS after every firmware update... oh, and they'll swear up and down that they're not using any hacked software. The last time that happened with the Wii, Nintendo said they would repair all affected consoles for free if they could not find any unauthorized software on the system. I think roughly zero people took advantage of the offer. :D
Yes it has been hacked using those Hack Flash Cards.....Who are these losers anyway? The 3DS Does everything it should, games, video, music, pictures....There is no need to hack it man!! I agree, I am not happy about this in the slightest. Because of actions like these it could potentially lead to Nintendo and third party developers losing money if games are pirated again. Worst part for me is I want to get a career in the gaming industry, how am I supposed to do that if there are no jobs left since the lack of funding for developers to expand or afford staff. :(
Nintendo can update the 3DS so that will probably help out. plus the 3DS hasn't been hacked in a sense that they have total control over the system. They only modified a "whitelist" that blocks the R4. It will be a bit longer b4 it has been officially hacked.

That makes sense because the 3DS is fully backwards compatible with the DS, so there aren't any new safe guards to prevent pirated DS games from working. All the new anti-piracy measures are aimed at stopping 3DS games from being pirated.

There you go. If they hacked it to play 3DS games, they would have showed a 3DS game being played. And there isn't much point in putting effort into blocking pirated DS games considering that market will soon be dead. There are so many options Nintendo has to stop piracy on the 3DS. Streetpass, Spotpass, automatic updates and required updates to play future software and games. So lets say someones walking around with a flashcart in their 3DS and Spotpass automatically downloads an update off an open wireless hotspot. You could even get the update through streetpass automatically from someone else who's downloaded the update. And new games could come preloaded with the updates(not that people will be BUYING new games if they use pirated software and fashcarts).[QUOTE="Javinho"]

Please stop overemphasizing the affect of piracy on the gaming market. PC games are the only ones that have any notable loss. Not every DS game that someone downloads is one that they would have ultimately bought. Don't forget that we are in a recession and you are talking about the entertainment industry. When people don't have money, games are one of the first things to get cut from a person's budget.
Do you think if poor people couldn't pirate games anymore they would all of a sudden start buying them? The DS is hugely popular and I imagine the overall affect of piracy is minimal since most casuals, kids, and parents don't know what the hell a flash card is.

as of now, the xbox360, wii, psp, ds and ps3 can now play pirated games. 3ds can play pirated ds games but it can't play 3d games. So far, the 3ds, wii and psp vita is gonna take some time for it to be pirated. When that time comes theyd better do something about that.

It's a problem. Don't act like it isn't. People shouldn't buy products if they can't afford to get the goods they want for it, people can get jobs and can save up.
There is no excuse for piracy, and anyone who buys (likely used systems anyway) consoles just to pirate games coz they can't afford them shouldn't be welcome in the industry and quite frankly the industry can survive without them.
