I expect more and more devs to take advantage of it. Usually it's games that don't have major characters so I doubt it would be in Mario Kart but I could be wrong and it could. You never know

I'm fairly sure that with Xbox 360 you can have your music playing over the actual game, I know that when I was playing GRAW online on my cousins 360 he had one of his songs playing.
