The parents are the ones who end up paying if the child is found negligent--the parents are usually sued at the same time or later, either for negligent supervision or on a theory similar to respondeat superior (the tort doctrine that makes employers responsible for the negligence of employees in some situations).

why is this happening in the first place, i thought there wasn't any way that a 6 year old girl would be sued. If the woman was older she would have moved, therefore not been injured. If it would have been an instant kill i would have maybe understood it more, but 3 months?

Maybe sue the parents instead because they are responsible for the kid. Kid is going to have a record if she loses though.

I personally think toddlers shouldn't be handling vehicles at such a young age. But suing for this type of accident is dumb.

How would that make sense? If the parents have to take responsibility of her actions if she is has to fork over money, then why is the judge treating her as an adult? Shouldn't the child be responsible for her own lawsuit according to the judge?

Sorry, even at my current age (20), I wouldn't have even thought of suing a 6 year old girl for her actions when she was 4. Even if it killed me. But that's just maturity talking.
