What this guy is doing is definitely not legal. Also there's the age laws and driving laws. So no, it's not 100% legal. I think the guy who fell backwards was shopping on an lsd trip or something similar. I certainly have never seen this kind of constistent imbalance with alcohol. Every object appeared nearer to him and he consistently fell backwards.

I really doubt he was on acid. I've never seen anyone act like that on acid, tripping in public is usually really upbeat and cheery, not slow and confusing. Not in California, Denver, parts of Canada, Amsterdam, etc, etc Besides, who cares if weed is illegal or not? It's never stopped me or anyone else I've ever known from smoking it. It'll be legal in more and more places as time goes by.
