While I don't think what he did was appropriate two years is a little harsh. As for why this didn't fall under the First Amendment, I'm not really in the mood to look at a picture of a teen simulating fellatio, but if the picture is how the wording describes it then it may not have fell under free speech simply because of it being considered obscene to simulate a sex act in public.
