It's a stupid law as it is difficult to enforce. But I do believe there would be less accidents if people didn't use iPods or phones while crossing a road.

Good, I hate when pedestrians yap on the phone and cross. Ipod is bogus though.

Don't be an ASS. It's for safety. Depending on the circumstances you could be ticketed for jay walking. If IT'S NOT WRECKLESS.. IT IS NOT JAY WALKING!! If you don't cause a traffic disruption or accident you didn't jay walk. During a human versus car collision the car always wins. So the pedestrian has the right of way. ALWAYS

Pedestrians ALWAYS have the right of way. ALWAYS. The driver's test regarding pedestrians is. "Who has the right of way, under which circumstances and when?" The answers are. PEDESTRIANS, ANY and ALWAYS.

Getting ticketed for spitting on the sidewalk is a common law. It's because of chew. People used to spit tobacco everywhere.

Not always. That would be dangerous and irresponsible. For example, on a highway, pedestrians do not have the right of way.
Pedestrians always have the right of way in certain situations, like certain crossings.
You're getting right-of-way confused with another concept; the one were a car shall never strike another person. If someone is jaywalking, you must stop for them as long as it is safe to do so. You can't just hit them because they aren't supposed to be there.
Anyway this law is ridiculous. Just because someone is wearing an mp3 player while crossing the street does not mean they are not paying attention.

If pedestrians automatically had the right of way, then they wouldn't get ticketed for jaywalking.

Cars have the right of way. That's why pedestrians have to walk it to that little button, press the little button. And wait for the little walkey man signal to show up before they can cross the street.

Saying that pedestrians have the rright of way is like saying that someone turning right on red has the right of way.

Depending on the area, pedestrians do have the right of way at certain times. For instance, on the campus where I go to school, cars must stop if people are about to enter a crosswalk...
