- No evidence
- Man gets sentenced to 7 years anyway

"Despite a lack of evidence in the trial, the judge took Coast's word over Montgomery's and sentenced the innocent man."

I'm surprised she even got two months. I remember it being said most district attorneys are reluctant to press charges against women for false rape accusations due to fear it may make legitimate victims afraid to come forward.

She felt guilty about it, confessed to lying and paid $90, 000 dollars in compensation. Also, since when did libertarians like the TC read the Huffington Post?

Simply, lets make the people which makes a false rape claim has to serve at least whatever the innocent party had to served. And that would be that.

"Also, he said, "If you put her in jail the message you send to other people who have done this ... if you come forward we're going to lock you up."" This is a very good point. As fair as it would be to crack down on serious perjury, you don't want to disincentivise them from coming forward and clearing people's names. Also, highly misleading topic title...unless you focussed on the porn part as an attack on religious people, rather than women?

She confessed to the crime though. They even had the gall to only give her two months and a 90k fine. She even gets to pick when she can go to jail. This is not retribution, just a slap on the wrist.

Well, but this seems like an unusual case since, well, there wasn't no evidence yet he still got convicted. Knowing you would serve the same time as the person you accuse would be a significant deterrent for this type of false claims. Would some people still take the chance and falsely accuse someone, sure, but a significant lower number.

yeah and if she had been thrown in prison for years that would deter people from coming forward.  The real issue is that a man was convicted without sufficient evidence

She should be in jail for at least 4 years.

Actually on second thought she lied when she was 10. How the hell does a judge sentence a 14 year old to 7 years of prison? This whole thing baffles me.

As it should. People should be deterred from making false accusations.

I meant coming forward to correct their false accusations like in this case

She's 26, correct? It says in 2000 that she was 10. Oh and yeah I misread that, she said she was molested when she was 10 when she was 17 apparently? Still makes absolutely no sense.

I don't believe a damn thing in this article now.

Okay. She's 10 in 2000. Let's assume that she hadn't had her birthday yet. She turns 11. It's 2013 now, she's 24. The article says that she's 26. No idea how these people can screw stuff like this up.

He's right though about the age. It said in the article she was molested when she was 10 years old in the year 2000. But in the article is states that she is currently 26 years old.

If she was 10 years old in 2000, she would be 22, 23, or 24 today. Not 26

Or if she is 26 now, then that means she was either 12, 13, or 14 in 2000.

The article is not correct somewhere....

I would go with Frank Green of Richmond Times-Dispatch, who cannot get his facts or math straight as it is his byline on the article.

Well thats fvcked up. Can't really do anything to harsh to her because that discourages coming forward. That judge should get thrown in jail for sentencing a man with practically no evidence.

Person0

That's not sound logic. It may prevent somebody who made something up from changing their mind and admitting that they made it up. That's true.

But the real problem is a judge who would put somebody in prison with no evidence. It is the judges fault. You cannot just ignore what she did and give her a slap on the wrist because you *hope* that in the future somebody else who lied to put somebody in jail may find it in the kindness of their heart to come out with the truth.

If you want to prevent this from happening, they should come down on the judge HARD to let them know that you cannot just throw innocent people in jail with no eviedence just becuase somebody accused someone of something.

Plus, giving the woman a harsh sentence would discourage people from falsely accusing others in the first place.

I said the judge should be punished... The problem with punishing her is that no one would have ever found out if she didn't come forward, so punishing her would just lead to people not coming forward after false accusations.
