Actually, automatic weapons are legal. You just need a federal license.
EDIT: actually, I need to correct myself. It's not technically a license. You just have to pass a BATF background check and pay a $200 tax upon reciept of your automatic weapon. As long as you pass the background check and pay the $200, you can't be denied.
So, as long as someone doesn't have a criminal record and has $200 to spend on the tax, then they can get a fully automatic weapon.

If you aren't convicted then you aren't convicted. I left out one step, though, and it can be a doozy. In addition to passing a BATF background check and paying $200, you also have to have signed consent from the head of a local law enforcement agency, like a county sheriff or a police chief. Depending on where you live, this can be tricky. Where I live, it isn't tricky at all. Sheriffs here are elected and if you live in a rural area, a sheriff isn't likely to turn you down since he needs every vote he can get. In my case, I would just go over to the sheriff's house and ask him for the favor.
