Let's say you were sitting down at the table enjoying a bowl of oatmeal or something that you just unpackaged. As you are eating you notice something foreign and spit into the bowl and see a maggot infested rat chunk. would you try to sue the company? Personally I wouldn't. Maybe see about reporting it. Maybe a refund if I am tight on cash and want to buy a snack.

No, because someone has to pay for the court's time to allow such garbage. I for one, would simply bring it back to the store to get a refund. Things aren't perfect in life and you shouldn't be allowed to sue for anything, which it looks like for the most part they have attempted to clean it up. Unfortunately, there are still many many ambulance chasers. Now, if there was evidence that said material in the oatmeal was deliberately placed in that box, then you have a gripe.

No, I'd make no scene and ask for a refund and probably not return to that establishment. I don't see what damages were caused to even consider suing :\

If I have to waste my time going back to a store because someone messed up, I deserve more then just a refund. I'm not saying that I would sue, but the last thing I wanted is a maggot infested rat chunk in my cherrios.

I would not sue. I would report it, get a replacement meal or a refund, and then decide whether to eat there again in the future.

Edit: Ok, so I should have read the first post, and thought you meant at a restaurant.  What I said I'd do, I probably would do at a resaurant, but in that case, TC, I don't know if there'd be much you could do about it other than just get something else to eat.  It would be difficult to prove it came that way, and it would probably cost more in time and court fees than it'd be worth.

Assuming if I did find maggots in my cereal box, I would call the store where I bought it and request an exchange. More then likely the store would probably honor a $4 box of cereal rather then losing me as a customer for life.

If I'd find a chunk of maggot infested rat in a box of OATMEAL, yes I would sue, how the hell could they even screw up so bad to allow for rats and maggots to get into their food? that goes beyond a simple fabric error, its just a sign of horrible, HORRIBLE control and safety meassures in the factory.

Well, the first thing I'd do is attempt to keep my gag reflex in check...

I'd then take it back to the store with a complaint, in the hopes that those who packaged it get torn a new arsehole.

I wouldn't sue, though. That's just dumb.

If I got sick from it, then I'd probably sue. They should definitely cover my medical costs for their mistake. Beyond that though...while it could be a lucky goldmine, I doubt I'd sue. I'm not particularly vindictive or greedy - I'd just want a refund.
