In his opinion, Justice Tingling specifically cited a perceived inequity in the soda rules, which applies to only certain sugared drinks beverages with a high milk content, for instance, would be exempt and would apply only to some food establishments, like restaurants, but not others, like convenience stores.

It applies to some but not all food establishments in the city, Justice Tingling wrote. It excludes other beverages that have significantly higher concentrations of sugar sweeteners and/or calories.

The judge also wrote that the fact that consumers can receive refills of sodas, as long as the cup size is not larger than 16 ounces, would defeat and/or serve to gut the purpose the rule. The judge also appeared to be skeptical of the purview of the citys Board of Health, which the Bloomberg administration had maintained has broad powers to seek to better the publics health. That interpretation, the judge wrote, would leave its authority to define, create, mandate and enforce limited only by its own imagination, and create an administrative Leviathan."

An incredibly stupid law to begin with. I'm really sick and tired of these knee-jerk reactions to situations. Why can't we educate the public rather than try to legislate problems away?

I liked it when the Judge told Bloomberg to go to hell and take his tiny soda cup with him.

At least in actions. When you're a Bloomberg intent on banning everything you don't like, having your authority challenged like this has to be similar in effect to being given the middle finger.

Apparently they always knew the law wouldn't last long, and they also knew it was kinda stupid, but they thought it'd be a good ad campaign for people to realize how bad for you gigantic sodas are. It probably failed even in that regard. People drink giant sodas to stick it to the man now, rather than out of sheer gluttony before.

Good I guess. It was a stupid law that wasn't going to change anything. That being said, I have lost faith in humanities ability to regulate its own body weight, so I would advocate a law forcing all fatties to go to the gym... Not really.... But sort of.

Good I guess. It was a stupid law that wasn't going to change anything. That being said, I have lost faith in humanities ability to regulate its own body weight, so I would advocate a law forcing all fatties to go to the gym... Not really.... But sort of.

That was only part of the reasoning behind the ruling. The most important aspect was the strong rebuke of the Public Health Department's attempts to act as an imaginative appointed Legislature.
