Raised in a $1.5 million Barrington Hills home by their attorney father, two grown children have spent the last two years pursuing a unique lawsuit against their mom for "bad mothering" damages allegedly caused when she failed to buy toys for one and sent another a birthday card he didn't like.


The alleged offenses include failing to take her daughter to a car show, telling her then-7-year-old son to buckle his seat belt or she would contact police, "haggling" over the amount to spend on party dresses and calling her daughter at midnight to ask that she return home from celebrating homecoming.

Last week, when the court record stood about a foot tall, an Illinois appeals court dismissed the case, finding that none of the mother's conduct was "extreme or outrageous." To rule in favor of her children, the court found, "could potentially open the floodgates to subject family child rearing to … excessive judicial scrutiny and interference."

In 2009, the children, represented by three attorneys including their father, Steven A. Miner, sued their mother, Kimberly Garrity. Steven II, now 23, and his sister Kathryn, now 20, sought more than $50,000 for "emotional distress."

What a bunch of idiots is my thoughts on it. I wonder if the woman divorced the man for supporting such nonsense. It would serve him right if she did and got more than half the estate. Ingrates are what those kids are and more than spoiled rotten.

*edit* After reading the article, it appears that they were divorced and the kids, the ingrates that they are, couldn't be talked out of said lawsuit by what appears to be a colluding father. Wall banging smiley

I could have maybe been able to justify it if she actually did like you know, bad motherly things, but people who waste the legal system's time on things like this should have to pay any expenses that were used by the defendent or government.

This is all actual good mothering. Shame it didn't seem to do anything for them.

Unless this is all part of an elaborate Parent Trap-like scheme, I don't even know why they would've tried this to begin with.

The civil legal system needs overhauled. If someone pursues a frivolous lawsuit and loses....they should have to pay for the waste of services to the taxpayers.

Well I think the lawsuit may have some value...Someone has to be to blame for those kids being spoiled as hell.

If they Sue their dad for bad parenting then it might be worth while.

I have a feeling that this was due to the kids not liking their mother and less about them being spoiled. I mean if they really wanted something couldn't they have just asked their father? I think they just hate their mother and tried to bend the law in their favor.

God this type of thing makes me rage. Thank God the Judge had sense and (eventually) dismissed the case.

Those kids are spoiled selfish morons.

Is it really possible to sue for something like "Failing to take her daughter to a car show," or "Haggling over the amount spent on a party dress?":| This case was frivolous and wasted people's hard-earned tax dollars.

Children do not get that ridiculous sense of entitlement from nowhere. The parents had to let it happen. I feel sorry for her because not only are her kids stupid, her husband is too, but not too sorry because she's the one who raised entitled brats.

This is just infuriating. This is just a way for the father to get back at his ex for whatever reason he had by bringing up a petty lawsuit, plain and simple. The whole thing should have never reached an appellatecourt in the frist place. These brats are grown-ass adults, but I think the judge should have granted permission to have the mom whup their asses and dad's for wasting everyone's time with this BS.

Sounds more like a case of bad fathering, given that the dad is an attorney and probably helped insert thoughts of useless litigation into their minds. The kids should be subjected to community service or something else for wasting the court's time.

Are they really that out of touch with the rest of the world? Where getting a less expensive party dress instead of a super expensive party dress, or getting a birthday card that doesn't have money in it means emotional distress and bad parenting? Ridiculous.

I hope one day they realize just how stupid this was and regret it. Probably not, though.

When I read the first part about being raised in a 1.5 million dollar home I already knew those kids were spoiled rotten and had a huge sense of entitlement. If they could sue for their "miserable" life in their mansion I wonder if I could sue my mom since I lived in the projects for a few years, had to eat generic brand cereal instead of the name brand stuff, and was restricted to two or three new games a year if I was lucky. I will give it to my mom, while those spoiled kids were complaining about not getting care packages in college my mom thought about me enough to send me care packages while I was in Iraq.

Wouldn't that prevent certain classes from seeking justice due to a lack of funds to pay for the service should the opposition win the suit?

Not that I'm condoning this suit or these people's attitude. That just seems like a really bad idea to me.

The parents were divorced and the "kids" were "raised in a $1.5 million Barrington Hills home by their attorney father." It sounds like it was the father that did most of the spoiling, not the mother (which the kids apparently think means "bad mothering".)

Not that I'm condoning this suit or these people's attitude. That just seems like a really bad idea to me.

Maybe in those cases the court could be pick up the tab but overall I agree with LJS the losing party needs to cover the legal fees if they can afford just to keep some of these "lawsuits" from actually reaching court.
