He spent the night one time to hang out with my brother, I saw that they were playing xbox so I set my ipod on the armrest of the couch and played with them. The guy sat next to me. I went upstairs really quick, came back down and started playing again. I didn't realize that it was missing until he left the next morning. I looked for i, couldnt find it.
During school i asked him if he knew what happened to my ipod. He said that he saw me take it upstairs. I started getting suspicious so the next day I asked him if I could see his ipod. He said yes and asked why, I said "no reason." He told me it was in his locker. As we approached his locker, he stops and says "o wait I forgot, I left it at home." So I go "ok bring it monday i wanna see it." Then he says "you think i stole it huh? well i wouldn't steal anything from a person that i know could beat me up" I think this is total BS because he is one of those kids who think they are tough and can beat anyone up. And also, how would he know that it got stolen?
My friend is good friends with the thief's sister. My friend calls her and asks her to talk to her brother about the ipod. He puts it on speaker phone...She says that hes had a new ipod for a week. Mine's been missing for a week. She says that its one of the new ipod nanos: the silver one with a black wheel. The same one as mine. Then the sister goes "wait, aren't you borrowing this from a friend. Trevor right?" We can hear the thief in the back saying "yea yea yea yea its its trevors." like he was nervous.
I ran into him at school today and i tell him "i want that ipod" and he just walks away from me trying to avoid eye contact. He kept saying "man i ain't got no ipod," "i don't know what your talking about." If he truly did not have the ipod he would have been a lot more defensive about it.
Sorry for the long read. This is all I really have, but as far as physical evidence, I have none.

tell your parents, tell a teacher. principal or whatever. tell him you will get the police involved.
well you're doing the right thing by talking to him and getting in his face about it. tell him you want to see his ipod to see if it matches your serial number and if it does you got your ipod back. tell your thiefs sister to be a mole and give you the serial number via phone or whatever. get your brother to steal it back for you if he goes over one day.
keep on persecuting man, this guy made a dumb move by stealing from someone who he sees all the time. it may take some time but be smart about it and you'll get it back eventually. same thing happened to me, i knew who stole my stuff, i had no proof, kept a close eye for a long time, dumbass brought it back one day, and while he was in the gym i went to the locker room and BAM, stole it right back. he confronted me and I told him "you stole it from me first" and he had nothing to say.

Anyway, even if you've got solid 100% indisputable proof that the guy stole your ipod, I seriousaly doubt that they're gonna get a search warrant to retrieve your stolen iPod. Dude, it's a freaking IPOD.Â

The thing is, I don't think the sister will tell me if the serial is correct. My friend has asked her to check the ipod and she hasn't really made an effort too. She's siding with her brother.
I believe you should be come a tattle and tell everyone he knows, especially mommy and daddy. If that doesn't work, invite him to the movies, sit down and say "I'll go get us some drinks and popcorn." Then when you get his drink, slip him a rouphee(sp). WHen he falls asleep, you can go back to his house with his keys in hand. If parents ask, tell them he sent you to get something out of his room. They know you're friends, so they'll think nothing of it. Then you can tear up his room to find your ipod. Take a poo in the middle of the room and leave a note with a happy face on it, showing your happiness that you've gotten your iPod back.

or tell your parents about it, have your parents talk to his parents, get your brother to tell your parents your story is true.. and with pressure from his parents, the kid will give the ipod back to you.
Throw him to the ground, get on top of hm and tell him "if you don't give me back my ipod, I'm going to beat the living **** out of you". At that point he'd probably scared by the fact that you got physical and he's give it back that day or the next. If not ;)OK...

No, they won't care or do anything. When relatively inexpensive things get stolen and other crimes aren't involved, they really don't give a ****. All they will tell you is that they can't do anything because its your word versus his. Doesn't matter if you have the serial number, unless its on documentation you got with the ipod, because you could just as easily have copied the serial number off the dude's ipod... Â
Call the police. With what you have it should be enough. If you have a bill of sale keep that and all the cases ect. First of all how old are you? If you are not old enough to file a complaint you have to have your parents call the police for you. To be honest with you it could come down to your word vs. his especially if his sister takes his side.
You also have to decide, or your parents if you want to press charges. The charge wont be stealing the IPOD it will be possestion of stolen property which is the same level offense as actually stealing it. Call the police or have your parents call and report it stolen. Provide the serial number and they will go over and talk to him. This one should be easy for them to handle. Sounds like it would not take much to crack this kid.
