Problem is, there have NEVER been U.S. trials for POWs or "enemy combatants". There weren't exactly U.S. trials of German and Japanese prisoners after the war. There were the Hague trials for the Nazi leadership, but that's the World Court, and nobody at the World Court wants to touch trying these people. That's what makes this whole "I can't believe we're not extending Habeas Corpus to the prisoners at Guantanamo!" so silly to me. They're NOT U.S. citizens! They've never even BEEN in the U.S., how could they possibly be tried by "a jury of their peers" here? Literally the first time they'd ever have been in the U.S... would be to go on trial.
This is an "image" move only. Barack's not dumb (which is why I voted for him), he'll just move the prisoners to another location and set up an altered version of military tribunals. Which is going to make a lot of people go apesh--, for one reason only... they can't imagine that Bush did ONE SINGLE THING right. As a result, Obama's going to take tons of useless heat because he's not going to roll back every single thing Bush ever did. Which will be quite stupid. But, alas.

At least with prisoners of war you know what country they're from, what part of the military they belong to, etc. With these groups that don't represent a country, that don't belong to any military, or anything, they need to be held somewhere. How can you prove it one way or the other? Pretend one guy that actually IS a terrorist is in court. How do you prove it? He had a gun, shot at soldiers, therefore he's a terrorist. That's lacking evidence in a legal system. How many juries are going to buy that?
