Well the ones who have been legally dead and pulled through usually do so by rececitation, correct? Or if not I'm assuming they do so before they go from the hospital bed to the morgue, so what I'm really interested in is just how making love to a recently deceased person is going to work, what with all the medical staff having duties pertaining to said corpse.

Well yes it is. Of course it is. The case would be characterised by what the doer thought he/she was doing to the dead woman.

In an example:

If for instance a man thought that his wife was asleep on bed while she was really dead without him knowing and decided to have sex with her then that's not necrophilia.

If though a person decides to have sex with someone he thought was dead (but isnt - he/she is just asleep) then its still necrophilia.

In your example the person wants to have sex with a dead person regardless if during the process she is brought back to life. And thats necrophilia.
