I lost my job as a waiter last month, i got layed off. So yesterday i started a job at a cold cuts sandwich store. It's mostly making bubble tea, sandwiches, and bakery goods. I have to drive 20 minutes to get there and put quarters in the meter for parking not to mention gas. So yesterday i didn't get paid, today i didn't get paid. I asked him when will the pay start and he said when your training is over and your good at the job. Now obviously i'm not going to be as fast as the other employees because i just started. I don't know where everything is placed and i'm just not as good as the manager. So i go in again tommorow and on saturday. I doubt i'll get paid tommorow and i don't know about saturday. Should i say something to the manager tommorow or just keep quiet. thanks for any advice

er.. that sounds a bit sketchy to me. I don't think they have to pay you for a video time/orientation/sitting around training day, but if you're out on the 'front lines' doing things, new or not, you should be getting paid. with the logic he has there, if you're never particularly good at what you're doing he never has to pay you. they have to pay you while you're still learning. You're working, even if you're learning.

I've never seen a job that doesn't pay you for that stuff. I don't know if it's state law, but orientation/training is still considered work where I live.

good god man, low pay. minimum wage here is $9.79 lol. They do have to pay you for your training time too, which should be included on your first check.

If you're actually doing work and not just reading a manual or something, it's illegal for him not to pay you for that time. I'd be prepared to find a different job. There's not much worse than working for a shady employer.

I would say that manager is breaking the law, at least as it is in most states. You can't work people for nothing. Now, if you signed a contract with them saying that you'd work for nothing during training, that's different. You should talk to the manager again and if he still gives you the runaround, you might speak to the owner.

Pay is typically bi-weekly (or every 2 weeks) but if you started work on a pay week, then your first pay check will take 3 weeks to get.

It probably varies stat by stat on when the lay requires you to be compensated. If you look on alot of national employers websites they will say, paid training, they wouldn't bother to say it if some places didn't pay you during training. You would consult your unemployment office perhaps? If you where laid off, you should be receiving unemployment benefits, which i'm sure are better then your $7 an hour sounds like a crappy place to work job. I'd say stop going and find something better.

New york city nassau county, i want to be paid while i train cause like i said i have to pay for gas and parking just driving there also time. According to him, it's 1-5 days training depending how good you are, no pay while training. If you're terrible during training he can fire you.

At least in Canada the law is that you are paid for training (explicitly written in the law) ...

Well then you're getting doubly screwed, because minimum wage in New York (and, in fact, the federal minimum wage) is $7.25. In other words, even if the unpaid training is lawful, it is still illegal for you to be paid that little. I think you and your boss better have a chat.

Dude, minimum wage in New York is $7.25 as of last year I believe. You are getting paid below minimum AND doing hands on WORK for free. You are getting ripped royally here, if he decides to fire you or not let you work there bring this up. This is illegal and he will get into some trouble here. If you didn't sign a contract saying otherwise (assuming you are 18, if not, then you are not legally bound by this contract) then this is illegal.

Mcdonald's pulled some stuff like that on me, saying that I'd get put on payroll "in a week or two." the third day I worked there. When my shift was over, I made a couple double quarter pounders and left. Also, because everyone there hardly spoke in English or at least acted that way.

If it was not ensured that you understood what the compensation would be when you accepted the job offer, this place of employment is sounding sketchier by the minute.

Usually paychecks come at the end of the week on a day designated by the company or they come every two weeks.

You should work out a contract with the manager containing: How many hours of work you are entitled during a month, what your sallary is without and with overtime and so on... then you check monthly that you've been paid the sallary you agreed on in the contact. And learning your job, is part of your job, so I see no reason you should not be paid.

I didn't say that? I meant you're earning money as long as you're clocked in regardless of what you're doing. When the money is given to you is a different story.

I just went through the same thing at a local cafe, 3/4 of my shifts so far were unpaid 'training' shifts. I considered it more like tryouts than training. I was I the 5th person they tried, so in total they got close to 60 hours of free labour. Pretty ridiculous and I'm sure very illegal, but my advice is just keep your head down and power through, or start looking for another job.

well of course you don't get paid daily. it's usually weekly or bimonthly. ask your manager when the next pay day is. don't be shy, it's a very normal and important question that any new hire is expected to ask.

Get on to some sort of citizens advice bureau. They will let you know where you stand. If you're not getting paid, I wouldnt do it. He could have you 'training' for 2 weeks and let you go without paying you a single penny.
