A San Diego college student filed a legal claim Wednesday for damages suffered when he was left handcuffed and without food or water in a Drug Enforcement Administration holding cell for five days last month.

A DEA statement said Daniel Chong, 23, was "accidentally left" in a holding cell.

"Accidentally? He almost died," said Chong's lawyer, Gene Iredale. "It's inexplicable."

Chong drank his own urine to survive as his cries for help were ignored by federal agents and inmates in nearby cells, Iredale said.

The fifth-year engineering student at the University of California, San Diego, was detained on the morning of April 21, a Saturday, when DEA agents raided a house they suspected was being used to distribute MDMA, commonly known as ecstasy.

A multi-agency narcotics task force including state agents detained nine people and seized about 18,000 MDMA pills, marijuana, prescription medications, hallucinogenic mushrooms, several guns and thousands of rounds of ammunition from the house, the DEA said.

Chong admitted going to the house "to get high with his friends," the DEA said. He later told a San Diego TV station that he knew nothing about the other drugs and guns. He was never formally arrested or charged, the DEA said.

The agents sent seven suspects to county jail and released another person, but Chong "was accidentally left in one of the cells," the DEA said. The agency did not explain how he was forgotten for five days in the small, windowless cell.

I don't even know what to say how the hell can you forget someone for five days without food or water it makes absoultely no sense. He almost died for chrissakes screaming cries of despair and yet he was ignorned. Complete bull**** i can't fathom this conundrum it's ridiculous.

dude 5 days in a windowless cell with no food or water would feel like a CENTURY, just like the guy who was left in the elevator for 41 hours

That sucks for him but it's part of the risk you're taking when you're going to get high with that much stuff in there. He'll probably make a few bucks off of this, though.

I should have been a little more clear, I meant getting arrested is part of the risk. With that many drugs in the house, a conviction could result in decades behind bars for trafficking.

The part about being locked in a cell for five days is something that should result in some people fired and possibly criminally charged, but it would have never happened if he wasn't going to the house to get high in the first place.

That's sad. Hope he's doing okay. I remember researching solitary confinement and reading about what it does to people. While this wasn't solitary, I can assume the feelings he felt of going crazy would probably be similar. I don't care if he wanted to go get high. He's not a drug dealer, he's not running a ring or making meth in a bathtub. There is no excuse as to why he shouldn't get a massive payday for this.

Drinking his own urine while handcuffed and likely without cups must have been... difficult...

While I'd say he deserves some sort of punishment for breaking the law with drugs, that's just so far beyond what's acceptable that it's a complete joke.

Well I was once left handcuffed in a closet for 8 hours for a joke. It wouldn't have been so bad except my arms were raised about my head and it was so freakin' small. It was hell, and that was only 8 hours...good god...

nearly the same thing happened for a client of ours back when I worked at a law firm, except it was 2 or 3 days they forgot about her... she didn't drink her own urine though from what I remember anyhow, the most dangerous thing that could ever happen to you from smoking pot is not the drug itself, but how law enforcement and the rest of our brainwashed society deals with it

Him getting arrested isn't the focal point of this topic at all. It's being treated inhumanely in a modern western country. For five days this guy was treated worst than a terrorist at Guantanamo bay.

I don't think anyone is complaining about the initial arrest.

My point was he would have never got treated that way if he didn't decide to be a dumbass and get high in a house full of drugs and guns. The smart druggies go elsewhere because the difference between simple possession and possession with intent to distribute is a HUGE amount of jail time.

I already know OT is mostly for the legalization of most or all legal drugs (varies based on poster what should be legalized) but until it happens the cops have to enforce the current law. They can't pick which laws they want to enforce unless they want to risk being fired and possibly charged with a crime themselves.

But of course, I already said in the part of the post you didn't quote that those officers who were responsible should face termination and criminal charges. Nobody deserves that kind of treatment and the man is probably going to get rich off of it (although I wouldn't put it past him blowing it on more X).

You're confusing personal discretion with actual policy. Just because a police officer let you off with a warning when he pulled you over for speeding doesn't mean he was authorized to do so in his particular precinct. For all you know if he was caught just giving you a warning he could have been fired.

He was selling ecstasy. I don't think it matters what he was selling, all drugs should be legal in the first place.
