So what if this person was trying to kill you and you kill them instead why is it that the person still goes to jail for it.
You don't, unless you used unnessesary force. If it was kill or be killed, then you don't. If he shot and missed, then you have all rights to shoot back, even if you kill him. However, say he had a knife and lunged at you. If you turned around and shot him 3 or more times, that is unessesary force. You would not get murder, though, it would be a much, much lessar crime of 3rd degree manslaughter.
